DECISION:
The BOARD OF APPEALS, at a Public Hearing held FRIDAY, JULY 119
1986 at 1:30 p.m. in the Town and County Building, Nantucket, made the
following Decision upon the Application of TERRENCE H. LAUNDRY (070 -86)
address 3 Thurston's Court, Nantucket, MA 02554.
1. Applicant seeks a VARIANCE from the rear lot line setback
requirements of Zoning By -Law SECTION 139 -16C. Such relief is sought
for purposes of mortgagability, with the building to remain as sited
approximately 4.75 feet from the rear lot line. The premises are lo-
cated at 3 THURSTON'S COURT, Assessor's Parcel 42.3.4 -144.1 (Land
Court Plan 24627B, Lot 2) and zoned RESIDENTIAL -OLD- HISTORIC.
2. Our findings are based upon the Application papers and test-
imony at the hearing. The encroachment of inches into the required
5 -foot rear yard setback was found in a survey presented on mortgage
plot plan dated June 17, 1986 of record. We are told that the founda-
tion itself is outside the setback, and pre -dates zoning. In replacing
a building once carried by that foundation, a new building was con-
structed which extended a few inches outwardly from the foundation.
At the northeast corner, the full 5 -foot setback was not maintained.
No bad faith or carelessness was evident.
3. We find that bringing the structure into strict conformity
would be unreasonable, a severe financial hardship and not necessary
to insure uniformity of affect in the ROH District. The sought relief
may be granted without substantial detriment to the public good and
without nullify ing or substantially derogating from the intent or
purpose of the zoning chapter. The Planning Board recommended favora-
ble action.
4. Accordingly, by UNANIMOUS vote, this Board GRANTS to Applicant
the requested VARIANCE with respect to setback.
