DECISION:
The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, JULY
11, 1986 at 1:30 p.m. in the Town and County Building, Nantucket, made
the following Decision upon the Application of ANN S. KILLEN (069 -86)
address Easy Street, Nantucket, MA 02554.
1. Applicant seeks a SPECIAL PERMIT under Zoning By -Law SECTION
139 -33A to alter or extend a commercial use, non - conforming as to the
required off - street parking, and under SECTION 139 -18E to obtain
relief as to one parking space. The premises are located at the CORNER
OF EASY STREET AND OLD NORTH WHARF, Assessor's Parcels 42.3.1 -13, 14,
152 77 and 78 as "A" and "B -1" of Plans 7301 -B and 7301 -C at
14 Easy Street, the address of the principal commercial building on
the premises. The district is zoned RESIDENTIAL - COMMERCIAL.
2. Our findings are based upon the Application papers, viewings,
and testimony at our hearing. At the outset, we note that Applicant
appears as owner of all the contiguous parcels listed above; hence,
they are treated as merged for our zoning purposes.
3. Applicant's real estate office uses 650 SF in the southeast
corner of the principal building (3 off - street parking spaces). Other
uses include 540 SF of retail space with 3 employees (4 OSPS), 400 SF
of storage space (1 OSPS) and 4 apartments (4 OSPS); hence, a total of
12 off - street parking spaces are now required. Applicant has 2 open
spaces off Easy Street and one under cover with access (generally
blocked) from SouthTilater Street via a way. With nine spaces short for
the principal building uses alone, the premises are non - conforming as
to use. (With L dwelling units, they are non - conforming iri that res-
pect as well.)
4. Applicant asserts that the shortfall is grandfathered. To
(069 -86) -2-
fully determine the matter, the proposed use of her dwelling for the
real estate office (see 068 -86) would have to be considered, along with
the Tobacco Shop use on Lot 78. In any event, she proposes to substi-
tute a retail shop for unspecified but likely high quality wares in
place of 650 SF office use. Where 3 off - street parking spaces are
now required, the retail use with one and up to 4 employees would call
for 4 spaces. (After close of the hearing, Applicant offered to make
usable the covered parking space off South Water Street to meet this
shortfall.)
5. In view of the unfavorable recommendation of the Planning
Board and the evident impact on existing congestion in the area, we are
unable to find on this record grounds for parking relief or for a
Special Permit to alter and extend the existing, non - conforming uses.
6. Upon motion to grant the requested relief, Board members
Vollans and Beale voted in the negative. Relief is accordingly DENIED.
