Leddy, Jr. Acting Chairman BOARD OF APPEALS BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, JULY 119 1986 at 1:30 p.m. in the Town and County Building, Nantucket, made the following Decision upon the Application of ANN S. KILLEN (068 -86) address Easy Street, Nantucket, MA 02554. 1. Applicant seeks a SPECIAL PERMIT under Zoning By -Law SECTION 139 -33A to alter or expand a commercial use, non - conforming as to the required off - street parking, and under SECTION 139 -18E to obtain any needed relief from the parking requirements. The premises are located at the CORNER OF EASY STREET AND OLD NORTH WHARF, Assessor's Parcels 42.3.1 -13, 149 15, 77 and 78 (numbers 14, 15 and 78 identified by Applicant as Lots C, B and D -1 including Applicant's residence at 10 Easy Street referpd to below). The zoning district is RESIDENTIAL - COMMERCIAL. 2. Our findings are based upon viewings, the Application papers, and testimony at our hearing. At the outset, we note that Applicant appears as owner of all of the contiguous parcels listed above; hence, they are treated as merged for our zoning purposes. 3. Besides Applicant's dwelling on Lots 78 ( "D -111), 14 ( "E ") and 15 ( "B "), our attention has been directed to her real estate office on Lot 13 (in a building extending over Lot 77). She proposes simply relocating that real estate use from office to home. She would continue as before with one employee (receptionist), although the office space in her home may be used by others who are not employees, no increase in intensity or space of office use is proposed. Only the dining room, library and entry hall (total 522 SF) would have office use, the rest continuing as Applicant's dwelling. 4. The real estate office use has been conducted on the premises (068 -86) -2- since prior to zoning, though not in her residence for the last 3 years and more. Applicant has at least 3 off - street parking spaces on the premises but might otherwise assert a claim of "grandfathering ". Our record is incomplete as to other commercial uses on the premises including a retail tobacco shop on Lot 78 ( "D -1 ") at 2 Old North Wharf and other uses (see 069 -86) on Lots 13 and 77; and how far back to- ward mid -1972 such uses were continued. The claim of non - conformity for lack of all required parking spaces is supported. 5. In any event, the proposed transfer of the real estate office use from one building to another on the premises, without extension, is not substantially more detrimental to the neighborhood than the existing use. No relief from the off - street parking is required or granted. 6. The Planning Board's recommendation was unfavorable on grounds the area is already congested. No other objection was heard. As noted above, the proposed change in itself should have no adverse impact. 7. Accordingly, this Board by UNANIMOUS vote GRANTS to Applicant the requested SPECIAL PERMIT under SECTION 139 -33A to transfer her real estate office into her home on condition that it be owner - occupied, with no more than one regular employee.
