DECISION:
The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, JUNE
27, 1986 at 1:30 p.m. in the Town and County Building, Nantucket, made
the following Decision upon the Application ofJAMES AND SANDRA L. OLNEY
(063 -86) of 11 Pilgrim Road, Nantucket, MA 02554.
1. Applicants seek a SPECIAL PERMIT under Zoning By -Law SECTION
139 -27J to be relieved from their 27F "building cap" covenant. That
covenant applies to the premises at 11 PILGRIM ROAD, Assessor's Parcel
41 -215, Lot 18 of Land Court Plan 13199 -I, Certificate of Title 10,520.
The zoning district is RESIDENTIAL -1.
Based upon the Application papers, correspondence and testi-
mony, we find that Applicants acquired the premises about June 1983. In
order to proceed to construct their new residence without the usual
building cap delay, they elected to execute a standard covenant in
accordance with Section 139 -27F. Mr. Olney, skilled in building, pro-
ceeded with construction pursuant to a building permit. Without yet
obtaining a Certificate of Occupancy or finishing construction, they
have used the premises as their owner - occupied residence year- round, as
the covenant requires. However, the five -year term of the covenant will
not start to run until an occupancy permit is obtained.
3. Applicants are said to have had the property on the market
since May. They fear a buyer will not pay a reasonable price if burden-
ed by the year -round occupancy requirement of the covenant. The un-
finished house is said to be their principal asset, with insufficient
finances to complete it.
4. Meanwhile, they are preparing to move to Maine where furniture
is said to have been shipped. Purchase there may await sale here.

5. Nothing of record indicated any bad faith in entering or
seeking relief from their convenant. Nonetheless, the Board is unable
to make a unanimous finding of such unreasonable personal or financial
hardship as would meet the conditions for Section 139 -27J relief. Given
• rising real estate market and continuing demand for year -round housing,
• factual basis is lacking to establish unreasonableness in remaining
obligated to sell, subject to the covenant, property first listed in May.
6. This Board is mindful of precedents for granting relief but
deeply concerned that 27F covenant commitments freely undertaken be
fairly respected and sustained.
7. Accordingly, upon motion made to grant the requested relief,
two members (Vollans and Sherman) voted in favor and one (Beale) was
opposed. Relief is, therefore, DENIED.
