Sherman, Chairman BOARD OF APPEALS vri If eel BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, JUNE 27, 1986 at 1:30 p.m. in the Town and County Building, Nantucket, made the following Decision upon the Application of CHARLES H. MCGILL AND SHIRLEY H. MCGILL (062 -86) of 51 Union Street, Nantucket, MA 02554. 1. Applicants,seek a SPECIAL PERMIT under Zoning By -Law SECTION 139 -33A to expand and alter their existing, nonconforming single - family residence, with relief from the applicable side and rear lot line set- back requirements of SECTION 139 -16C. They would be permitted to con- struct a second -story addition, partially within the setback, without change of "foot- print" or ground cover ratio. The premises are located at 51 UNION STREET AND 3 WEST DOVER STREET, Asaesor's Parcels 55.1.4- 061 and -62. Plan Book 41, Page 477, and zoned RESIDENTIAL -OLD- HISTORIC. 2. Based upon the Application papers, viewings, HDC plans and testimony offered at our hearing, we find that Applicants jointly own parcel 55.1.4 -062 but only Charles H. McGill is listed as owner of par- cel 55.1.4 -061. Assuming this continues so, the lots would not be treated as merged for zoning purposes but separate. The dwelling as shown on 5/12/86 plot plan of record is on the "61" lot, and relief herein is accordingly applicable to that lot. 3. Lot "61" of 1860 SF has a northerly side lot line about 0.3 foot from the dwelling at one point. The northwest dwelling corner is about 1 foot from the rear lot line. The dwelling predates Charles McGill's 12/9/80 acquisition, also mid -1972 zoning, and is thus a "pre- existing, non - conforming" structure to which Section 139 -33A applies. Because the proposed second -story addition increases the non - conforming nature of the structure by extending into the setbacks, the 139 -33A for single- family residences does not remove need of a special permit. (062 -86) -2- However, the addition will not overhang or otherwise make more non -con- forming the intrusion into the setback already exising on the first - floor level. Building code 21.01- 0.4 -0.1 was noted. 4. With favorable recommendation of the Planning Board, immediate and other abutters and no opposition, we find that the extension will not be substantially more detrimental to the neighborhood. Rather, re- lief here would be in harmony with the general purpose and intent of the zoning chapter. 5. Therefore, by UNANIMOUS vote this Board GRANTS to the owner of parcel 55.1.4 -61 (Charles H. McGill, solus, on this record) the re- quested relief by SPECIAL PERMIT pursuant to SECTION 139 -33A to construct the second -story addition substantially in accordance with the plans now of record with the Historic District Commission.
