DECISION:
In the matter of the Application of RAYMOND I. DAWSON, JR.
(061 -86), at a meeting of the BOARD OF APPEALS held at 1:30 P.M.
on Friday, June 27, 1986, at the Town and County Building, Nantucket,
the Board enters the following Decision and makes the following
findings:
1. This is an application for a VARIANCE granting relief
from Nantucket Code §139 -16.A and C (Intensity Regulations -
Minimum Lot Size and Side Line Setback) . If granted, the Applicant
would be permitted to maintain his existing dwelling,
notwithstanding the fact that the nonconforming lot upon which it
exists came into separate ownership from adjoining land in 1973,
after the effective date of the zoning by -law, and thus would
cure a defect affecting marketability of his property. The premises
are located at 67 ORANGE STREET (Assessor;s Parcel 55.4.1- 79.1),
Plan Book 15, Page 108, and are zoned RESIDENTIAL -OLD HISTORIC.
2. The premises consist of the land shown upon the plan
recorded in Plan Book 15, Page 108, with the exception of the
land under the building shown on the plan as "Building Owned by
Town ", and the narrow strip between the Town -owned building and
Orange Street. (A predecessor in title to the applicant had
conveyed this parcel to the Town.) The premises thus contain
less area than the 4120 square feet shown as lot size on the
plan. From 1965 until January 2, 1973, the premises were in

common ownership with the land to the north, shown as "J. Alden
Manley" on the plan; on January 2, 1973, they were conveyed to
the Applicant and another person, who has since died, while Mr.
Manley retained the adjacent land to the north. The conveyance
of January 2, 1973, had the effect of creating a division of land
in common ownership so as to leave one lot undersized and with a
side line setback nonconformity, and thus was a violation of the
zoning by -law. The Applicant asks this Board for variance relief
to confirm this boundary line.
3. This Board finds that, owing to circumstances relating
to the shape of the land and structures thereon (consisting of
the existing nonconformities in lot size and side yard setback)
which affect the premises, but not affecting generally the zoning
district in which they are located, literal enforcement of the
provisions of the by -law would involve substantial hardship to
the Applicant (consisting, again, of the existing conditions upon
the lot, and the fact that the nonconforming lot is in separate
ownership from any land in common ownership), and that desirable
relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the
intent or purpose of the by -law (in that no change in conditions
oapon the ground will result). The Board further finds that the
proposed change is in harmony with the general purpose and intent
of the Zoning Act and the Nantucket zoning by -law, for the same
reasons.
4. For the reasons herein set forth, the BOARD OF APPEALS
hereby GRANTS the Applicant relief from the zoning by -law, Nantucket

Code §139 -16,A and C, permitting the Applicant to maintain his
existing building upon the premises notwithstanding nonconformities
in lot size and side line setback, by a VARIANCE, by a UNANIMOUS
VOTE.

BUILDING, FEDERAL AND BROAD STREETS, NANTUCKET, on the Application
of RAYMOND I. DAWSON, JR. ( 061 -86), seeking a VARIANCE from

Lot Size, Side Line Setback). If granted, the applicant would
be permitted to maintain his existing dwelling notwithstanding
a technical zoning defect affecting the marketability of title,
