Sherman, Chairman BOARD OF APPEALS 0 f / Ild O�Z QQQ yPM iel 4// ���+y, Nun %/% fM1 &64�- BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, JUNE 279 1986 at 1:30 p.m. in the Town and County Building, Nantucket, made the following Decision upon the Application of JEFFREY MOORE (059 -86) of Washington Street, Nantucket, MA 02554. 1. Applicant seeks a VARIANCE from the requirements of Zoning By -Law SECTION 139 -16A as to minimum lot size and SECTION 139 -16A and C as to front and side yard setback for a secondary dwelling. The premises are located at 1 POLLIWOG POND ROAD AND VESPER LANE, Assessor's Parcel 55421.19 La* 2 Plan Book 22, Page 25 and zoned RESIDENTIAL -10. 2. Based upon the Application papers, correspondence, plans, building permit application 4684 -86 and testimony, we find that Appli- cant's predecessor, by Planning Board endorsement dated 11/8/82, ob- tained an ANR subdivision dividing Lot 2 from Lot 1, i.e., Parcel 55- 421.2 next west on Vesper Lane, not in issue here. The predecessor held the two lots in common ownership until shortly after the 4/83 Annual Town Meeting at which zoning was raised from Residential -1 to Residential -10. When conveyed to Applicant in May 1983, Lot 2 of 0.19A was less than the required 10,000 SF minimum size. 3. Pursuant to Building Permit approved 1/10/84, Applicant added a secondary dwelling of about 1284 SF to the lot. The permit application was incorrectly marked by the then Building Inspector to show zoning as 9-1 (still in effect across Vesper Lane to the north). If R -1, the actual 7 -foot setback would have conformed with the required 5 -foot minimum. But for R -10, a 10- foot'side yard setback is specified. (Appli- cant, at the hearing, adopted an irrevocable election to treat his lot as fronting on Vesper Lane, although his street address An One Polliwog Road. Siting of the secondary dwelling relative to the principal dwel- ling requires such election as per Section 139- 7A(2)(b).) In any event, the setback with respect to the Polliwog Pond Road lot line is not (059 -86) -2- taken as 20 feet for front yard but 10 feet for side yard. We note the R -10 requirement of 75 -foot frontage. See Section 139 -33F. 4. The Board finds that the siting of the structures relative to the lot lines of this corner lot do not generally affect the Resi- dential-10 zoning district in which the premises are located. Given Applicant's asserted good -faith acquisition of the lot and siting of the secondary dwelling and the absense of opposition, we further find that a literal enforcement of the Zoning By -Law would involve a sub- stantial hardship to Applicant, whereas the desired relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the By -Law. 5. Accordingly, the Board by UNANIMOUS vote GRANTS Applicant the requested VARIANCE from SECTION 139 -16A and C requirements as to minimum lot size and side yard setback.
