DECISION:
The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, JUNE
27, 1986 at 1:30 p.m. in the Town and County Building, Nantucket, made
the following Decision upon the Application of GILBERT AND MARY KENNEDY
BAUMSLAG (057 -86) of 4 Darling Street, Nantucket, MA 02554.
1. This is an Application for a VARIANCE granting relief from
the intensity regulations of SECTION 139 -16 of the Zoning By -Law or in
the alternative a request for a DECLARATORY JUDGMENT.
2. The Board is without express authority to grant declaratory
relief; however, the board may and does herein make specific findings
relative to the Applicants' request for a Variance. Upon the Application
papers, viewings, plans, assessor's records, Applicants' statement of
relevant facts and a certificate over the name of Josiah S. Barrett,
and other representations and testimony received at our hearings on
May 30, 1986 and June 27, 1986, we have found, as follows:
3. The premises are located at 65 ORANGE STREET, and are shown
on Assessor's Map 55.4.1 as Parcel 78.
4. The premises were purchased by the Baumslags in 1986 from J.
Alden Manley. Manley had owned the premises since 1958. In 1965, Manley
purchased a smaller, abutting parcel and held it in common with the
locus until January 2, 1973 at which time he conveyed to Dawson and Lane.
The lot conveyed to Dawson and Lane, containing less than 4120 SF, was
undersized under the new Zoning By -Law, which had been enacted in July
1972.
5. The Baumslag lot has frontage in excess of fifty feet on both
Orange and Fair Streets, and it contains in excess of 5000 SF of area.
The structures on the premises which pre -date 1955, do not exceed the
50% maximum ground cover ratio. No prohibited structure on the lot stands

within five feet of the southerly boundary line between the Baumslag lot
and the Dawson lot.
6. It being that the de facto resubdivision by conveyance to
Dawson and Lane of an undersized parcel did not create a nonconformity
in or on the Baumslag lot, and it did not make more nonconforming any
previously existing nonconformity, we find no need for the requested
relief by Variance to be granted. While title to the Baumslag lot may
have been tainted by the nonconformities of the Dawson Lot and its
relation therewith, Baumslag � lot conforms with Section 139 -16 but for
an intrusion into the northern side line setback which lawfully existed
prior to zoning and was unaffected by the conveyance to Dawson and Lane
of the undersized lot to the south. Moreover, by our Decision of June
179 1983 in the matter of the Application of Raymond I. Dawson, Jr.
(061 -86) entered immediately previous to this Decision, such taint
as may have come into being as a result of the said conveyance has been
removed.
7. Therefore, in accordance with the foregoing findings, this
Board, by UNANIMOUS vote DENIES the Applicants' request for such VARIANCE
relief.

FEDERAL AND BROAD STREETS, NANTUCKET, on the Application of GILBERT
AND MARY KENNEDY BAULSLAG (057 -86) seeking relief by VARIANCE
and /or DECLARATORY RELIEF under SECTION 139 -16 of the Zoning By-
Law, to cure a technical zoning defect that affects marketability
of title, the maximum ground cover ratio and side line setbacks.
In the absence of Variance relief, Applicant requests Declaratory
findings that relief is not necessary. The premises are located at
65 ORANGE STREET, LOT 78, ASSESSOR'S MAP 55.4.1 and zoned RESI-
DENTIAL -OLD- HISTORIC.
