Sherman, Chairman BOARD OF APPEALS 44s�rll si �7 �'�6 BOARD OF APPEALS TOWN OF NANTUKCET NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a Public Hearing held FRIDAY, MAY 30, 1986 at V-30 p.m. in the Town and County Building, Nantucket, made the following Decision upon the Application of MARY LOU LARUE (051 -86), address Hawthorne Lane, Nantucket, MA 02554. 1. Applicant seeks a SPECIAL PERMIT under Zoning By -Law SECTION 139 -22E to conduct her existing jeep rental business at a different location, specifically at SQUARE RIGGER ROAD, Assessor's Parcel 48.69. These premises are in the zoning district RESIDENTIAL - COMMERCIAL -2 and shown as Lot 29 on Plan 14342 K, Cert. 9893. 2. Based upon these Application papers and those of the Historic District Commission received with testimony at our hearing, we find that Applicant was , last season, operating her small -scale Nantucket Jeep Rental business at a site opposite the Airport entrance. That location is now barred to her with development of the Nantucket Inn complex. She acquired the proposed site May 7, 1985 for use in the current 1986 season subject to obtaining relief here. Siting near Nobadeer Farm Road is planned for 1987. 3. On the proposed site is planned a 10' x 12' office structure and five parking spaces of about 20' x 45' overall. The area is generally residential. Applicant has and will locate the rental operation so as gererally to be screened from other lots by existing vegetation. 4. No opposition was heard. The Planning Board's recommendation is understood to be favorable. 5. Section 139 -22 lists specific uses permitted in any zoning district, only by Special Permit. We are to determine whether the pre- requisites for a Special Permit are met under Section 139 -30A. We so find, namely, that the proposed use on the premises for the current 1986 season would be in harmony with the general purposes and intent of the (051 -86) -2- Zoning By -Law chapter. That harmony is ensured by conditioning the use upon its siting where screened by natural vegetation , limiting the use to no more than 6 4- wheel -drive vehicles ( "jeeps ", not necessarily AMC Jeeps) and the duration of the Special Permit to October 15, 1986. 6. Accordingly, by UNANIMOUS vote this Board GRANTS to Applicant the requested SPECIAL PERMIT under SECTION 139 -22, subject to the above noted conditions.
