BOARD OF APPEALS
DECISION:
At a Public Hearing of the Board of Appeals held on Friday, May
30, 1986 at 1:30 p.m. in the Town and County Building, Nantucket, in
the matter of the Application of JOHN E. REED (049 -86) address P.O. Box
398, Westfield, MA 01086, the Board enters the following Decision and
makes the following findings:
1. Applicant seeks a SPECIAL PERMIT under Zoning By -Law 139 -33(A)
to enable him to replace an existing shed, bedroom and bathroom with a
bedroom and bathroom resulting in an increase of 250 square feet of
ground cover. Applicant further seekis a SPECIAL PERMIT and in the
alternative a VARIANCE under Section 139 -16 of the Zoning By -Law (ground
cover ratio). The premises are located on 3 Low Beach Road, Siasconset,
Lot 5, Map 7332 -027 and are zoned R -2.
2. Based upon the application papers, viewings, correspondence,
testimony and representations, we find that the structure, which is the
subject of this hearing, is a pre- existing, nonconforming structure. It
is an undersized lot and it does not meet the sideline setback
requirements. Applicant has owned this property for thirty years.
3. Counsel for the applicant stated that Applicant owns a
contiguous lot, which is 3,358 sq. ft. and Applicant is willing to
subject this approval on the combining of the two lots, which results in
a betterment of the existing situation:
Lot size (subject lot) 10,710 square feet
Allowable ground cover 12 1/2% = 1,758 square feet(per zoning
by -law)
Existing ground cover 20% = 2,156 square feet
With addition 23% = 2,406 square feet
With lots combined 17.8%
4. The proposed addition will extend approximately 8 to 10 feet,
but it will not be a further encroachment.
5. We find, therefore, that the proposed addition is clearly not
detrimental to the neighborhood.
6. The Planning Board's recommendation is favorable subject to the
combining of the two lots as stated above.
7. Accordingly, this Board by UNANIMOUS vote GRANTS to Applicant
the requested SPECIAL PERMIT under SECTION 139 -33(A) enabling him to
replace the existing shed, bedroom and bathroom with a bedroom and
bathroom and a SPECIAL PERMIT or to the extent required a VARIANCE
relative to ground cover ratio.
This relief is granted subject to Applicant combining his continguous

lot consisting of 3,358 square feet with the subject lot of 10,710
square feet, and recording such in the Registry.
