In the matter of the Application of GWEN GAILLARD (048 -86) , at a meeting of the BOARD OF APPEALS held at 12:30 P.M. on Friday, May 30, 1986, at the Town and County Building, Nantucket, the Board enters the following Decision and makes the following findings: 1. This is an application for a SPECIAL PERMIT under Nantucket Code, §139 -7.0 (Exception for Accessory Apartments) . If granted, the Applicant .could be permitted to install a year -round accessory apartment in her existing single- family home. The premises consist of the property approximately shown on Assessor's Map 55 as Parcel 404, are located at 86 UNION STREET (Plan File 14 -C, Lot 1) , and are zoned as RESIDENTIAL- COMMERCIAL. 2. Based upon the application and the materials and testimony presented at the public hearing, the Board finds that the premises consist of a parcel of land containing about 20,000 square feet, upon which are sited a single - family house and a cottage. (Based upon our examination of the Applicant's plans, it does not appear that the cottage is in compliance with the 12 -foot rear -to -front spacing requirement. of §139.7.A(2)(b); however, the completion of the Applicant's proposed changes as herein described, under the relief that we grant herein, will render this nonconformity moot) . The Applicant has presented a floor plan, showing the joining of the cottage with the main house by new construction; a copy of this plan (the "Plan ") being attached hereto as Exhibit A. 3. The effect of the proposed addition will be to create, by addition to the cottage and joining the new construction to the main house, an accessory apartment within the walls of the main house, having a gross floor area of 800 square feet. (The gross floor area of the main house exceeds 1200 square feet, so the requirements of §139.7.C(2)(a) will not be violated.) The accessory apartment will be self- contained, with separate cooking and sanitary facilities and two bedrooms. Both entrances will be on side walls of the building. Sufficient parking is provided on the site. 4. This Board finds that the proposed structure and use as a year -round accessory apartment are in harmony with the general purpose and intent of the zoning by -law, and that the proposed apartment appears to comply with all standards established in §139- 7.C(2). 5. The relief granted hereby is upon the following conditions: (a) That the proposed addition be constructed in strict conformity with the Plan. (b) That all requirements set forth in §139- 7.C(2) be complied with. (c) That, prior to the issuance of an occupancy permit for the proposed accessory apartment, the Applicant executed the restriction and affidavit required by §139- 7.C(2) (g) . 6.
