Sherman, Chairman BOARD OF APPEALS BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a Public Hearing held FRIDAY, MAY 30, 1986 at ]Z:30 p.m. in the Town and County Building, Nantucket, made the following Decision upon the Application of JEANNE KOFKIN (047 -86), address 209 Nina Court, Newport News, VA 23602. 1. Applicant seeks a VARIANCE under Zoning By -Law SECTION 139 -7 A (2)(e) to construct a secondary dwelling on her lot with slightly less than the 20% larger ground cover required with respect to the principal dwelling ground cover. The premises are located at 7 TROTTER'S LANE, Assessor's Parcel 67.280, Lot 1, Plan Book 19, Page 104, and zoned RESIDENTIAL -10. 2. Based upon the Application papers, viewings, and plans, testi- mony and representations received at the hearing (including "Exhibit 1 "), we find that Applicant's allowable ground cover is 2242 SF, and proposed is only 2226 SF. With the 20% rule of Section 139 -7A (2)(e), the proposed secondary dwelling is short by 110 SF but otherwise could conform to Section 139 -7A (2). 3. The secondary dwelling could alternatively be 20% less in ground cover than the princip&l but this would fail to meet the require - mants for family use as represented by Applicant. No objection to Appli- cant's proposal was received and the Planning Board's recommendation is understood to be favorable. 4. While ground cover limits are normanlly observed strictly in the interests of safety, etc., in this case a ground cover is sought slightly smaller than required. The requirement is understood to have been placed in the Code to avoid having principal and secondary dwellings (047 -86) -2- with comparable ground cover (and corresponding like - scale) on the same lot. Here, the two dwellings will be each of single -story wood frame construction but contrasted by respective 1062 SF and 1164 SF ground covers, per Exhibit 1. 5. Accordingly, we make the findings requisite to variance relief including hardship, special topography in the trapezoidal lot, and absense of substaiial detriment, nullification or derogation. 6. This Board, by UNANIMOUS vote, GRANTS to Applicant the re- quested VARIANCE, under SECTION 139 -7C (2)(e), conditioned only on the noted contrasting of single -story structures by ground cover, as shown in Exhibit 1 of record.
