Sherman, Chairman BOARD OF APPEALS 41��1401 , �v BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, MAY 30, 1986 at 1Z:30 p.m. in the Town and County Building, Nantucket, made the following Decision upon the Application of PATRICIA AND OWEN CLINTON (045- 86),address 484 St. Clair, Grosse Pointe, Michigan, 48236. 1. Applicants seek a SPECIAL PERMIT under Zoning By -Law SECTION 139 -7C to install an Accessory Apartment in their existing single- family residence enlarged to accommodate same. Applicants also seek SPECIAL PERMIT or VARIANCE relief from SECTION 139 -16 and 18 requirements as to ground cover, setback and off - street parking. The premises are located at 6 YORK STREET, Assessor's Parcel 55.14.056 and zoned RESIDENTIAL -1. 2. Based upon the Application papers, viewings following our initial hearing of May 2, 1986, correspondence and plans, testimony and representations received at our hearings, we find that Applicants' lot contains 3725 SF, i.e., less than 5,000 SF. Allowable ground cover ratio is 30 %, present ground cover ratio is 31% but an existing accessory building on the north lot line will be removed. 3. The house is non - conforming (but pre- existed our zoning) with no setback from the northerly side lot line. Applicants propose extending the house westward but spaced out of that setback to provide adequate space per Section 139 -7C (2)(a) for the Accessory Apartment. The structure will thus not be more non - conforming with respect to set- back, but only as to ground cover with an about 162 SF addition. The house is to remain single -story in the addition and structure linking it to the 1 1/2 story principal dwelling. Ground cover ratio would become 35 %, about 1955 SF over that specified for R -1 in Section 139 -16A. 4. As Accessory Apartments are strongly favored and abutters commended the enlargement, as such, without objection, we might normally have granted the requested Special Permit under Section 139 -7C together I (045 -86) -2- with Section 139 -33A relief as to ground cover (setback relief no longer being needed or sought). However, Applicants have one existing parking space off York Street and no claim to grandfathering as to a second. A second space could be provided end -to -end, normally not allowable under Section 139 -18. Objection was heard on behalf of the occupant of the abutting house at Applicants' southerly boundary concerned with this arrangement. No parking plan was available fully complying with the Code. Concern was expressed about lack of parking in the area, and the Planning Board's recommendation was unfavorable. 5. Accordingly, we are unable to make the findings necessary to support a parking variance. 6. Upon motion to grant the relief requested, the Board voted two in the negative and one in the affirmative (Williams). Accordingly, relief is DENIED.
