Any appeal from this action shall be made pursuant to Section 17 of Chapter 40A of the General Laws, and shall be filed within twenty (20) days after this date. William R. Sherman, Chairman BOARD OF APPEALS BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: At a Public Hearing of the BOARD OF APPEALS held on FRIDAY, MAY 29 1986 at 1:30 p.m. in the Town and County Building, Nantucket, in the matter of the Application of SYLVIA GRIGGS, TRUSTEE OF THE SYLVIA REALTY TRUST (044 -86), address 44 Claypit Hill Road, Wayland, MA 01778, the Board enters the following Decision and makes the following findings: 1. Applicant seeks a SPECIAL PERMIT under Zoning By -Law SECTION 139 -33 to alter or restore the recently fire - damaged CAPTAIN GARDNER HOUSE to its prior non - conforming use, clearing away fire - damaged portions and rebuilding it substantially as it was prior to the fire. The premises are located at 74 -76 CENTRE STREET, Assessor's Parcel 42.43 -099, in the RESIDENTIAL -OLD- HISTORIC district. 2. Based upon the Application papers, viewing, correspondence and plans made of record and testimony and representations at the hearing, we find that Applicant established a pre- existing, non - conforming use of the premises with 6 dwelling units, specifically, 5 apartments in the princi- pal structure and a cottage in the rear (not reached by the fire). First, second and third floor plans dating from 1979 were represented as accurate- ly showing pre- existing interior spaces. Proposed restoration will be in substantial conformity with these plans. 3. Applicant paperly claims grandfathering with respect to Section 139 -18 off - street parking requirements. Otherwise, Applicant would need relief under Section 139 -18G, having only one space. 4. The Planning Board's recommendation was favorable to restoration of what was legally in place before the fire. Neighborhood concern ex- pressed at the hearing was essentially limited to apprehension of nearby Quest -house owners and operators that demolition and construction during (044 -86) -2- the summer season would be damaging to them. 5. Section 139 -33 requires that we apply the Zoning By -Law chapter to the reconstruction of a structure lawfully in existence (except a single- or two - family structure reconstructed without increasing its non- conforming nature). Under Section 139 -8, a lot or dwelling containing more than one dwelling unit is normally non - conforming in the Residential - Old- Historic District. Hence, a Special Permit is required under Section 139 -33 to restore the structure and use of the 5- apartment Captain Gardner House to that pre- existing the fire. 6. In view of the absense of opposition structure, the prevalence of guest houses in t long history of the prior use without evidence we find that what Applicant proposes would not detrimental to the neighborhood. Its completed harmony with the general purpose and intent of to such restored use and he neighborhood, and the of neighborhood detriment, be substantially more retoration would be in the zoning chapter. 7. To ensure reasonable harmony during the clean -up, demolition and reconstruction necessary for such restoration, Applicant indicated a willingness to accept the following conditions: (a) Major demolition and reconstruction work on the premises shall be deferred until October 1, 1986. (b) Supplimental to the Nantucket Code Chapter 101 on noise prohibitions, noise disturbance frcmclean up, demolition and reconstruction work on the premises shall not be exempted between 7:00 a.m. and 8:00 a.m. Monday through Saturday and after 6:00 p.m. 8. Applicant's undertaking of early clean -up and sealing the struc- ture against blowing of ashes and other debris is noted. (044 -86) 9. Accordingly, this Board by UNANIMOUS vote GRANTS to Applicant the requested SPECIAL PERMIT pursuant to SECTION 139 -33 to restore the pre- existing use and to reconstruct the premises in substantial conformity with the floor plans of record, with conditions (a) and (b) above being imposed on the restoration work until completed.
