which has this day been filed with the Town Clerk.
Any appeal from this action shall be made pursuant to Section 17 of
Chapter 40A of the General Laws, and shall be filed within twenty
(20) days after this date.

DECISION:
At a Public Hearing of the BOARD OF APPEALS held on FRIDAY, MAY 29
1986 at 1:30 p.m. in the Town and County Building, Nantucket, in the
matter of the Application of SARAH BELL (043 -86), address 34 Hooper Farm
Road, Nantucket, MA 02554, the Board enters the following Decision and
makes the following findings:
1. Applicant seeks a SPECIAL PERMIT under Zoning By -Law SECTION
139 -33 to alter and extend a pre- existing, non - conforming single - family
residence by adding a partial second floor. Initially, Applicant proposed
increasing the ground cover by 50 SF and asked for Variance relief in
the alternative. Request for such relief was withdrawn at the hearing.
The premises are located at 34 HOOPER FARM ROAD, Assessor's Parcel 67 -131
and in the RESIDENTIAL -10 zoning district.
2. Based upon the Application papers, testimony and representations
and plans submitted at the hearing, we find that Applicant's existing
home is on an undersized lot (Lots A and B merged for zoning purposes)
and the allowable ground cover is 1556 SF. Actual ground cover is 1330 SF,
so the proposed 60 SF addition would not lead to an excess. Applicant's
problem then is the extension of a rear - facing dormer into the 10 -foot
rear -yard setback. This 1965 home is also non - conforming by extension into
the side line setback.
3. The pre- existing rear wall is 4 to 5 feet from the rear lot
line; hence, within the setback. The dormer will not extend as far to the
rear, thus will not increase the non - conformity. The roof line will be
permissably raised 4 to 5 feet to accomodate the dormer. We are told the
alteration has the approval of the Historic District Commission. The
Planning Board's recommendation was favorable.

4. No grounds for opposition being heard or perceived, we find that
the proposed alteration and extension of Applicant's residence would not
be substantially more detrimental to the neighborhood than the existing
non - conforming use. Rather, the proposal is in harmony with the general
purpose and intent of the zoning chapter.
5. Accordingly, this Board by UNANIMOUS vote, GRANTS to Applicant
a SPECIAL PERMIT under SECTION 139 -33 to make the alteration and extension
above - described and shown on the plans of record.
