Any appeal from this action shall be made pursuant to Section 17 of Chapter 40A of the General Laws, and shall be filed within twenty (20) days after this date. William R. Sherman, Chairman BOARD OF APPEALS BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHSUETTS 02554 DECISION: At a Public Hearing of the BOARD OF APPEALS held on FRIDAY, MAY 29 1986 at 1:30 p.m. in the Town and County Building, Nantucket, in the matter of the Application of MARK AND HOLLY A. BARBER (042 -86)9 address, 10 Golf View Drive, Nantucket, MA 02554, the Board enters the following Decision and makes the following findings: 1. Applicants seek a SPECIAL PERMIT under Zoning By -Law SECTION 139 -7C to incorporate an Accessory Apartment in their existing single - family residence. The premises are located at 10 GOLF VIEW DRIVE, Land Court Plan 28933K, Lot 70 in the RESIDENTIAL - COMMERCIAL -2 zone. 2. Based upon the Application papers, testimony and representations and Applicants' plan sketched at the hearing, we find that Applicants have a single - family residence on their lot near it, an accessory building moved from another site. Applicants propose= building a linking structure between these buildings enclosing a kitchen for the apartment. The apart- ment will have a bathroom, living and sleeping areas. Two or more off - street parking spaces are provided. 3. Although the proposed accessory apartment will be installed in a structure not presently attached and part of Applicants' residence, the structural link will satisfy the Section 139- 7(c)(1) requirement that the apartment dwelling unit be within the exterior walls of their home. Therefore, with size and design in conformity with Section 139 -7C, Appli- cants' proposal can qualify. Applicants have a bona fide intent to comply with the subsection (g) requirements of year -round occupancy. 4. The Planning Board's recommendation is favorable. 5. We find, therefore, that the proposed Accessory Apartment use and structure are in harmony with the general purpose and intent of the zoning chapter. (042 -86) -2- 6. By UNANIMOUS vote, this Board GRANTS to Applicants a SPECIAL PERMIT under SECTION 139 -7C (applicable to R -C -2 District per Section 139- 9A(1)) to install such Accessory Apartment as proposed.
