DECISION:
At a Public Hearing of the BOARD OF APPEALS held on FRIDAY, MAY 2,
1986 at 1:30 p.m. in the Town and County Building, Nantucket, in the
matter of the Application of ANN S. KILLEN (041 -86), address Easy
Street, Nantucket, MA 02554, the Board enters the following Decision
and makes the following findings:
1. Applicant seeks a SPECIAL PERMIT under Zoning By -Law SECTION
139 -18G for relief from the parking requirements arising from a new retail
use. The premises are located at ONE OLD NORTH WHARF AT THE EASY STREET
CORNER, in the RESIDENTIAL - COMMERCIAL zoning district.
2. Based upon the Application papers and viewing, correspondence,
testimony and representations, we find that Applicant has leased the
premises to Barbara Irion dba the Nantucket Woolgatherer. Not more than
400 SF will be used in the retailing of knitted woolen items. She will
be producing such items as a customary home occupation, the remaining
area of this small cottage serving as her single - family dwelling. There
will be no retail shop employees.
3. The off - street parking requirement for the proposed retail
store use is, accordingly, 2 spaces and presumably no greater as a custom-
ary home occupation per Section 139 -18J. Relief requires our finding
(a) that the granting of such releif is in harmony with the general
purposes and intent of the Zoning By -Law, and (b) that the required park-
ing spaces are physically impossible to provide, otherwise would have a
significant and adverse effect on the scenic and historic integrity of
the neighborhood. The parking space for the dwelling is provided on Old
North Wharf but, if not actually available off the lot of Applicant, the
requirement is met by grandfathering.
4. The two spaces for retail purposes cannot both be provided on
the premises and even one would mar the settled scenic environment of this
historic area. We therefore make finding (b).

5. As Applicant notes in her letter of April 21, 1986, traffic
has increased and heavy vehicles have been re- routed on Easy Street. But,
contrary to her assertion, a custom has not been established to waive
parking requirements in the older buildings in the center of Town. To the
contrary. We are persuaded to make finding (a), then, only upon imposition
of the following conditions:
A. The Special Permit shall be personal to Barbara Irion,
leasee we are told under a 5 -year lease with right of
_1 - renewal.
B. Use shall be restricted to her retail sale of knitted woolen
goods and related production of such goods in the nature
of a customary home occupation.
C. No employees shall work on the premises.
6. Testimony supported the very limited occasions that patrons of
the Nantucket Woolgatherer would need parking; rather, they customarily
come by foot as tourists or incidental to other in -town activity. A use
more intensive in its impact on parking or traffic could not be condoned
on Easy Street without strict zoning compliance.
7. Accordingly, having made the requisite findings, the Board
by UNANIMOUS vote GRANTS to Applicant the requested SPECIAL PERMIT under
SECTION 139 -18G upon the three conditions A -C noted above.

This application to the Board of Appeals for the waiver of
three parking spaces by Ann Killen for her 1 Old North Wharf
house is based on the small size and type of business to operate
there and the desire to keep one of the last vestiges of green
space in this section in tact. The 'Nantucket Woolgatherer',
a yarn shop which was previously on Centre Street, will be
operating in just under 400 square feet of actual retail space
(half the size of the former shop space) with the owner as sole
year round employee.
