DECISION:
The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, MAY 301
1986 at 2:30 p.m. in the Town and County Building, Nantucket, made the
following Decision upon the Application of LAURENCE J. CALDWELL (039 -86)
address 56 Somerset Road, Nantucket, MA 02554.
1. Applicant seeks a SPECIAL PERMIT pursuant to Zoning By -Law
SECTION 139 -33A "to rent 3 apartment units to year -round residents" and
in addition to rent 3 bedrooms as quest rooms. Applicant seeks relief
from the off - street parking requirements (SECTION 139 -18) by SPECIAL
PERMIT or VARIANCE. The premises are located at 63 ORANGE STREET, Asses-
sor's Parcel 55.4.16, Lot 3 of a 4 lot 1974 ANR subdivision. The zoning
district is RESIDENTIAL OLD HISTORIC.
2. Based upon the Application papers, viewings,,correspondence
and representations, testimony, plans and Assessor's card received at
our hearings, we find that Applicant had a pre- existing (pre- mid -1972)
apartment in the cellar of the two -story building. According to a 5/29/86
letter of Harold Ryder, Jr., his father Harold Ryder, Sr. built the
apartment in 1969 and lived in it, relocating to Monomoy in 1974, where-
after it was rented until a 1976 fire. Assessor's card of 2/16/83 shows
this lot 3 as "2- family" per 7/12/79 appraisal.
3. Although this matter was originally heard April 4, 1986 and
continued from May 2, 1986 (when Applicant's counsel was unable to at-
tend) to our May 30, 1986 hearing, we are unable to make a finding of
continued two - family use from 1976 to 1979 and 1979 to date on the record
made. In addition, the only plans submitted showing what Applicant pro-
poses to do (see copy of Building Permit 4526 -85 with 12/12/85 date,
received at our April 4, 1986 hearing) are for a single - family residence
on the first and second floor with just one kitchen. No basement or
cellar plans were offered.

4. Without an evidentiary basis for a Section 139 -33A finding of
pre- existing non - conforming use, we cannot give the relief requested for
3 year -round apartments, nor even two, although recognizing the Island's
need for such accommodations. As to the request for approving 3 bedrooms
for transient guest rentals, Applicant's counsel indicated that this
would not be pursued.
5. Off- street parking has been adequately provided on Applicant's
adjacent Lot 4. That lot was the subject of Applicant's request (our
file 056 -85) for a Section 139 -7C Special Permit to construct a new sin-
gle- family residence with accessory apartment. After objection was raised
that Lot 4 also provided parking for the (Ryder's) store at 59 Orange
Street on Lot 2, that Application was withdrawn without prejudice. Testi-
mony at our May 30th hearing affirmed tenant use of that parking lot
rather than on Lot 3, the premises of the present Application. Moreover,
Mr. Chaleki representing Applicant at our April 4th hearing had marked
on a plan drawn 3/14/86 4 parking spaces on Lot 3, space No. 1 being
located where a "wart" had been removed from the building.
6. Accordingly, we cannot make the findings necessary for Special
Permit parking relief under Section 139 -18G, nor of hardship, etc. re-
quired for a parking variance. If and when Applicant completed renova-
tion to allow conforming use of the premises as a single- family residence,
the required single parking space can and should be provided on Lot 3,
otherwise on Lot 4 (which appears now to be closed off to parking for
Lots 2 and 3).
7. Testimony and letters of abutters and the Planning Board were
unfavorable. We note that Applicant's counsel left our hearing of May
30th just prior to our reaching this decision, saying he wished to con-
fer with his client about requesting withdrawal of the Application with-
out prejudice, otherwise asking a continuance. We expressed unwillingness
to continue once more despite counsel's undertaking to waive any claim
to constructive grant of relief, also unwillingness to allow a with-
drawal without prejudice. Counsel declined our request to remain for our
discussion and vote on the merits.

8. Upon motion to grant the relief requested the vote was UNANI-
MOUS in the NEGATIVE. Accordingly, relief is DENIED.
