SANFORD (034 -86) , a copy of which is registered as Document No. 35489 and noted on Certificate of Title No. 9109 at Nantucket Registry District, is hereby amended, at the request of the Applicant, as follows: 1. The Decision permitted the Applicant to increase ground cover by 788 square feet, including 572 square feet for an addition to the main house, and 216 square feet for an addition to the cottage. The Applicant has now abandoned his plan to construct the addition to the cottage, but requests permission to add 684 square feet of ground cover to the main house. This will result in less additional ground cover than that already granted by this Board. Accordingly, the Applicant's request for amendment to the Decision is granted, for the same reasons cited in the Decision for the granting of variance relief. 2. The Decision contained the condition that the additions not be higher than the existing height of the main house and cottage, respectively. By this, we meant that the addition should, in the case of the main house, b6Thiaher in number of stories than the existing one and one -half story house. It has now been called to our attention by the Applicant that the existing twenty -foot height of the existing structure is excessively low for a one and one -half story house and that it is neither practical Page 1 of 2 nor feasible to build the addition at that height. He has presented to us a set of plans, approved by the Historic District Commission, which shows the maximum height of the addition at about 24 feet. A copy of the relevant sheet of these plans is attached hereto as Exhibit A. We find that the construction of the proposed addition to the main house in conformity with these plans is consistent with our decision in this case, and modify our decision to require that the addition be constructed in conformity with Exhibit A. 3. We further find that the amendments and clarifications contained herein are minor in nature and are consistent with an earlier Decision, which was made at a public hearing at which no opposition was expressed. Accordingly, we enter this Amendment to Decision, after presentation by the Applicant at a public, open meeting of the Board, without further public hearing or notice. Dated: TLtly Z� William-R. Sherman, Chairman BOARD OF APPEALS BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: At a Public Hearing of the BOARD OF APPEALS held on FRIDAY,APRIL 47 1986 at 1:30 p.m. in the Town and County Building, Nantucket, in the matter of the Application of EDWARD J. SANFORD (034 -86) address Polpis Road, Nantucket, MA 02554, the Board enters the following Decision and makes the following findings: 1. Applicant seeks a VARIANCE from the ground cover limitations of code SECTION 139 -16A to construct additions to main and guest houses. The premises are located at 315 POLPIS ROAD (Hollywood Farm), Assessor's Parcel 25 -6 (Land Court Plan 7300 -3, Lot 37) in the zoning district LIMIT- ED USE GENERAL -III. 2. Based upon the Application papers, and ground cover figures, testimony and representations presented at our hearing, we find that Applicant acquired the property February 6, 1980, including adjacent Lots 36,34 and 35. In furtherance of the open land acquisition program of the Nantucket Conservation Foundation, Applicant disposed of those lots; otherwise, no ground cover question would have arisen. 3. Given the scope of the properties and Applicant's rightly trea- suring the historic farm building, we are disposed toward the relief re- quested. While the barn serves functionally for storage of boats or vehicles, it and other out - buildings are part of the topography lending charm to the Polpis Road landscape. The guest house formerly housed mi- grant workers. Like the barn, it appropriately serves a contemporary function and, to this end enlargement of the guest house as well as the principal dwelling is appropriately considered. Applicant speaks of a growing family, in itself not reason for variance relief. But here clearly are the requisites for variance relief. 4. We have cited the structural topography of the premises, unique in its historic agricultural character, within the LUG -III district. En- largement is not feasibly accomplished by adding an upper story, the (034 -86) -2- principal dwelling already being 1 1/2 story. Hardship is present in any alternative of limiting ground cover by razing historic out - buildings. The extent of ground cover overage would, under other circumstances, be objectionable. Here, the 3% limit applied to a 179,224 SF lot yields a permissible 5377 SF ground cover, clearly adequate in other circumstnaces for accommodating large principal and guest houses. Applicant proposes 572 SF for main house and 216 SF for cottage, the 798 SF total bringing ground cover excess to 0.34 %. 5. Since preservation of the historic integrity and rural character of the Island are implicit objectives of the Code, we find the sought relief in harmony with its general purpose and intent, notwithstanding the unfavorable recommendation of the Planning Board. No other objection was heard. To further ensure such harmony, we condition relief upon restricting the 572 SF and 216 SF additions to not greater than the existing heights of the main house and cottage, respectively. 6.
