Dear Mr. Hourihan:
I respectfully request that I be allowed to appear before the Zoning Board of Appeals on
March 10, 2000 for a clarification of the above -named decision. A Special Permit was
granted by the Board on April 7, 1986 for the property located at 25 Prospect Street.
My reading of this decision is that it does not affect 23 Prospect Street. I represent the
present owners of 23 Prospect Street who are in the process of selling their property.
The Buyer's attorney feels that the decision written by the Board relative to 25 Prospect
Street is ambiguous and wants to be certain that the decision in no way affects 23
Prospect Street. May i be heard on the matter for clarification?

Dear Ms. Stover;
Please be advised that at a duly noticed Public Hearing held at
1:00 P.M., Friday, March 10, 2000, in the Conference Room, Town Annex
Building, 37 Washington Street, Nantucket, Massachusetts, the Board
considered the attached request for CLARIFICATION of the above noted
Decision.
The Board, by unanimous vote, makes the CLARIFICATION that the
Decision in BOA File No. 026 -86 pertained only to the Locus, shown as
25 PROSPECT STREET, Assessor's Map 55.4.4, Parcel 91, shown on Plan
File 22 -B, as Lot 2, and not in any way to land shown as 23 PROSPECT
STREET, Assessor's Map 55.4.4, Parcel 90, Plan File 22 -B, Lot 1, as
recorded in Deed Book 248, Page 209 in the Nantucket Registry District.
The Board finds that the text of said Decision clearly refers to relief
granted only to 25 Prospect Street, and the Notice and Application
clearly asked for relief only for 25 Prospect Street. There was no
intention of the Board at that time to encumber the property at 23
Prospect Street in any way by the conditions contained in said
Decision.
This Clarification does not require a new twenty -dav appeal
period to run.

DECISION:
At a Public Hearing of the BOARD OF APPEALS held on FRIDAY, APRIL
4, 1986 at 1:30 p.m. in the Town and County Building, Nantucket, in the
matter of the Application of MARILYN P. SEICHTER (026 -86), address 60
Washington Street, Suite 708, Hartford, CT 06106, the Board enters the
following Decision and makes the following findings:
1. Applicant seeks a SPECIAL PERMIT under SECTION 139 -33 or in the
alternative a VARIANCE with respect to SECTION 139 -16C (side line setback)
to change an existing shop into a single- family residence. The shop is
non- conforming by encr xhment on the setback. Premises are at 25 PROSPECT
STREET, Assessor's Parcel 55.44 -091 (Plan Book 16, Page 100) and zoned
RESIDENTIAL -1.
2. Based upon the Application papers and presentation at our hearing
we find that the shop pre- existed zoning and is non - conforming as to use
and setback encroachment. Presently the shop is on a lot with an existing
residence, but Applicant is filing for an ANR subdivision by line shown
on the site plan dated January 3, 1986. Until subdivided, the shop cannot
be converted to a residence without contravening the requirements of
Section 139 -7A(2) for a secondary dwelling. Additionally, after subdivi-
sion, the premises are not appropriately further improved beyond replacing
the shop with a house on its footprint, without overcrowding.
3. The following conditions are imposed to assure that the proposed
extension or alteration of the shop into a single- family residence will
not be substantially more detrimental to the neighborhood:
a. The single- family residence will not be constructed until
the ANR subdivision is of record.
b. The premises will not have further improvements and speci-
fically will have no secondary dwellings.

4. The Planning Board's recommendation was favorable, and no ob-
jection was heard.
5. With these conditions ensuring use and structure are in harmony
with the general purpose and intent of the Zoning chapter, this Board by
UNANIMOUS vote GRANTS to Applicant the requested SPECIAL PERMIT (denying
variance relief).
