Sherman, Chairman BOARD OF APPEALS BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: At a Public Hearing of the BOARD OF APPEALS held on FRIDAY, FEBRUARY 28, 1986 at 1:30 p.m. in the Town and County Building, Nantucket, in the matter of the Application of PAMELA G. JELLEME ET AL (023 -86) address Shimmo Road, Nantucket, MA 02554, the Board enters the following Decision and makes the following findings: 1. Applicants seek a VARIANCE under Zoning By -Law SECTION 139 -7A (2) (b) to construct a secondary dwelling with less than the required 12 -foot spacing between respective front and rear building lines of the secondary and existing principal dwellings. The premises are located at 30 YORK STREET, Assessor's Parcel 55.4.1 -150 in the zoning district RESIDENTIAL -1. 2. Based upon the Application papers. letters. testimony and repre- sentations, and site, floor and elevation plans made of record at the hearing, we find that Applicants propose to raze an existing garage sited in the southeast corner of the property. We are told that it encroaches upon the east side yard setback and is, thus, a non - conforming structure. 3. The proposed secondary dwelling would be sited in that corner, outside the setbacks. The SG &lar distance between it and the principal dwelling would exceed 12 feet but the rear building line of the principal building intersects the secondary dwelling footprint. Rather than the 12 -foot front -to -rear spacing required by the By -Law subsection, Applicants would go some 8 feet beyond even a zero spacing; that is, the secondary dwelling extends perhaps 20 feet too far forward. 4. On one recent occasion, this Board has granted a variance (001 -86) for a less - than -zero spacing, but that was in an approved cluster develop- ment with foundation already set per an issued building permit and with Planning Board approval and no opposition. Here, cluster -type density would substantially derogate from the intent and purpose of the zoning chapter. The Planning Board's recommendation is unfavorable and at least one abutter is opposed. (023 -86) -2- 5. Counsel for Applicants argues that an unsightly garage will be replaced, setbacks will be observed and two off - street parking spaces pro- vided. While such improvements would enhance the neighborhood, the sharp increase in dwelling density would constitute a substantial detriment to the public good. Neighbors are rightfully hopeful that Applicants will properly use the principal residence as a single - family residence and not allow its use by 5 or more persons who do not constitute a family. Alleged abuses presumably predate Applicants' 1985 acquisition of the premises. 6. Accordingly, we are not able to make any of the findings requisite under variance Section 139 -32A so as to &Z't favorably on Applicants' request. 7.
