025_ .e Board enters the following Decision and makes the following
findings:
1. Applicants seek a SPECIAL PERMIT under Zo N ing By -Law SECTION
139 -33A (alteration of a prior non - conforming structure and use) to change
what was a restaurant (the Opera House) into a retail store use and struc-
ture. The premises are located at 4 SOUTH WATER STREET, Assessor's Parcel
42.3.1 -178 and zoned RESIDENTIAL - COMMERCIAL.
2. Based upon the Application papers, viewings, testimony and repre-
sentations, and site and floor plans and a 6/12/84 Certificate of Inspection
received at our hearing, we find that the restaurant use pre -dated zoning,
going back perhaps to 1948. Discontinuance of restaurant operations since
the last summer season has not been an intentional abandonment for purposes
of reckoning off - street parking requirments. The building will not be en-
larged, within the sense of Section 139 -18A.
3. Accordingly, we first determine to what extent the new use may
benefit from "grandfathering" in meeting the subsection 18I requirement
for off - street parking spaces. The 1984 Certificate of Inspection carries
a sketch of the Opera House floor space with (revised) notation of 51 seats
in the restaurant and 15 in the bar. A maximum employee shift of 15 is Said
to be based upon representations of former manager Chick Walsh. If we ac-
cept these figures urged on behalf of Applicants 8 parking spaces are
grandfathered on the basis of seating and 5 spaces on the basis of employees,
or 13 total. (Other restaurant activity, to the extent carried on under
partial lease of a lot to the south is not seen as material here. Second
floor use was for waiting and restrooms, not material to the parking re-
quirement, a legend "dining" on a drawing dated 1/12/86 not withstanding.)

4. In the p,.�oposed retail store use, gross floor area is reckoned
at 1259 SF (first fl(,-)r) plus 616 SF (second floor), or a total of 9 spaces
at one per 200 SF. Applicant accepts a limitation to no more than 6 employ -
aes on maximum shift to assure conformity with the parking requirement,
and not more than two retail establishments.
5. The structure will be renovated in keeping with the Massachusetts
Building Code, and externally visible changes as to entry doors and the
like are to have Historic District Commission approval.
6. Delineation of the lot with Planning Board approval dates from
2/24/86. That Board has given a favorable recommendation, with certain
qualifications met here. No opposition was heard.
7. Accordingly, we find that change from the existing restaurant
use, non - conforming as to parking requirements, to the proposed retail
use with the two conditions noted, will not be substantially more detrimen-
tal to the neighborhood. The non - conforming structure will not be extended
nor made more non - conforming. Such changed use will be in harmony with the
general purpose and intent of the zoning chapter.
8. The Board, by UNANIMOUS vote, here GRANTS to Applicant Gwen
Gaillard, and to the Applicant Trust if the purchase is consumated, the
SPECIAL PERMIT requested subject to the two conditions, namely, the number
of retail establishments will not exceed two and retail employees on maxi-
mum shift not exceed 6.
