DECISION:
At a Public Hearing of the BOARD OF APPEALS held on FRIDAY, FEBRU-
ARY 281 1986 at 1:30 p.m. in the Town and County Building, Nantucket, in
the matter of the Application of CHRISTOPHER M. AND DOROTHY A. GORDON
(016 -86) address Box 2657, Nantucket, MA 02554, the Board enters the
following Decision and makes the following findings:
1. Applicants seek a modification of a prior VARIANCE (017 -86)
granted September 15, 1976 (for Lot 16, Plan Book 16, Page 9) to remove
the "restriction that no further improvements be allowed on either lot ",
i.e. said Lot 16 now Lot 1 here in question and Lot 2 in separate owner-
ship and not in issue. The premises are located at 9 TROTTER'S LANE, Plan
Book 125, Page 565 and Plan Book 129, Page 447, in the RESIDENTIAL -10 zone.
2. Based upon the Application papers (this and prior 017 -76),
viewings, testimony and representations, we find that the restriction was
in excess of any needed for zoning purposes since the rezoning of the
premises from R -2 (20,000 SF minimum lot size) and R -10 (10,000 SF).
This occured a few months after the September 1976 Variance grant. In
fact, the subject premises pursuant an ANR subdivision December 20, 1976,
contained 20,268 SF; hence, improvements on that lot were then improperly
restricted.
3. More specifically, we find that continuance of the restriction
against improvements would not be in furtherance of the intent or purpose
of the Zoning By -Law chapter nor of the public good. The Planning Board's
recommendation was favorable, and no opposition was heard.
4. Accordingly, this Board by UNANIMOUS vote GRANTS to Applicants
the requested relief, namely, MODIFICATION of the 1976 VARIANCE to remove
any condition or restriction.

FICATION of a VARIANCE (017 -76) dated September 15, 1976 (for then
Lot 16, Plan Book 16, Page 9) to remove a condition that no addi-
