Any appeal from this action shall be made pursuant to Section 17 of Chapter 40A of the General Laws, and shall be filed within twenty (20) days after this date. William R. Sherman, Chairman BOARD OF APPEALS BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: At a Public Hearing of the BOARD OF APPEALS held on FRIDAY, FEBRUARY 7,1986 at 1:30 p.m. in the TOWN AND COUNTY BUILDING, NANTUCKET, in the matter of the Application of RUSSELL W. AND MARY A. IULIANO (011 -86) address 191 Chapman Street, Watertown, MA 02172, the Board enters the following Decision and makes the following findings: 1. Applicants seek a SPECIAL PERMIT under SECTION 139 -7C to install an Accessory Apartment in a single - family home under construction. The premises are located at 40 WIGWAM ROAD, Lot 811, Land Court Plan 5004 -50, Cert. 10117, and zoned LUG -III. 2. Based upon Application papers, representations and testimony, we find that Applicants are able to conform the proposed first -floor Accessory Apartment to the requirements of 139 -7C and are prepared in good faith to execute and make of record the deed restriction specified in Subsection (g). Contrary to their entry on the Application form, they represent that use by children, friends, etc. will be restricted to the principal dwelling. Note is made that a permit may be revoked in case of any false statement or misrepresentation of fact in this Application (139 -26F). 3. As the adverse recommendation of the Planning Board was based upon the Application form entry their opposition appears properly to be overcome. 4. Under these conditions, we find that the requested relief may be granted in harmony with the general purpose and intent of the zoning chapter. 5. Accordingly, the Board by UNANIMOUS vote hereby GRANTS to Appli- cants the requested SPECIAL PERMIT under, and subject to the conditions of SECTION 139 -7C.
