DECISMN:
At a Public Hearing of the BOARD OF APPEALS held on FRIDAY, JANUARY
109 1986 at l: 30 p.m. in the "Town and County Building, Nantucket, in the
matter of the Application of CHARLES B. SH EEHAN (009 -86), address 69 N.Liberty
street, Nantucket, MA 02554, the Board enters the following Decision and
makes the following findings:
1. Applicant seeks a VARIANCE from Zoning By -Law SECTION 139 -16C
to allow construction of entry steps or stoop leading to a proposed new rear
door, the stoop extending into the rear -yard setback. The premises are
located at 14 SHEI.,L STREET, SIASCONSET, Lot No. 081, Plan No. 7313, in the
zoning district RESIDENTIAL - OLD - HISTORIC.
2. Based upon the Application papers, letters, a viewing, testimony
and representations, we find that Applicant's single- family residence is
a non- conforming structure in having its rear building line within 5 feet
of the rear lot line, i.e., in the rear-yard setback. To accommodate appli-
ances and water heater in a renovated laundry area, Applicant will be clos-
ing off an existing entry door. That door was particularly convenient to
use when parking on Folger Court near the property. To provide alternate
convenient access to the house, the new door is proposed. In a manner typi-
crI of Nantucl <et in -Town homes, the stoop would have stairs in either di-
ruction, left and right, from the doorway. The stoop would necessarily be
LuL]_v within Applicant's lot by proper survey and close to the lot line.
With such stoop, safe circulation about the house would not be blocked.
3. According to a neighbor, Folger's Way formerly extended across
the len.,th of Applicant's lot just beyond the rear lot line. This is shown
on map dated 1.892,revised1896. In any event, no neighboring structure is
proximate Applicant's rear lot line in the vicinity of the proposed stoop.
4. The i-mmediate abettor Tom S. Ward, Jr., through counsel, asserts
that r -i correct survey would show the rear lot line only 22 inches from the
rerjr of the house (assuming the reference to "side line" is inadvertent).
l ile a stoop, by definition unroofed, does not count as ground cover, the
�r1trrrnent is made that its construction will eliminate open space, adversely
intl_uence the Ward property, having an effect not to be desired. On the
Otlier hand, the Planning Board's recommendation was favorable.
.Ordinari_ly in the Residential -Old- Historic district, variance
relief to place a double - staired stoop so close to a lot line would appear
improper, In the compact and widely non- conforming house siting in the vil-
lrr;,e of Siasconset, however, such accommodation may, in instances such as
this, he appropriate.
6. Finding the site to that extent unique, we note that Applicant
,,,-ouLd face a considerable financial hardship to retain the existing door
11111d a practical hardship to find an entry stoop location free of zoning
pr_ohLems. Applicant must be mindful, also, of Building Code requirements
t -or entry door_ distance from a lot line, If Applicant is able to proceed,
we find the proposed stoop may be permitted by variance relief without sub-
stantial detriment to the public good and without nullifying or substantially
derogating from the intent or purpose of the Zoning By -Law.
7. Accordingly, the Board by UNANIMOUS vote GRANTS to Applicant a
VARLANCF: to construct a double- staired entry stoop open left and right to
ci_rcul.ation within Applicant's rear -yard setback in accordance with an ac-
curate sur.vev.
