Sherman, Chairman BOARD OF APPEALS BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: At a Public Hearing of the BOARD OF APPEALS held on FRIDAYIFEBRU- ARY 28, 1986 at 1:30 p.m. in the Town and County Building, Nantucket, in the matter of the Application of ISLAND MANAGEMENT, INC. D /B /A THE MUSE, FOR ITSELF AS LEASEE AND WBBO, INC. OWNER, (006 -86) address 44 Surfside Road, Nantucket, MA 02554, the Board enters the following Decision and makes the following findings: 1. Applicant for itself and for the owner seeks a SPECIAL PERMIT under SECTION 139 -33A of the Zoning By -Law to expand a pre- existing, non- conforming structure, the Muse, by the addition of an entry vestibule. The property is located at 44 ATLANTIC AVENUE, (now Surfside Road), Lot 20 of Land Court Plan 26439 -E, Cert. 6664, in the RESIDENTIAL -10 zoning district. 2. Based upon the Application papers, viewings, site plan, testimony and representations at the hearing of February 28, 1986 to which this matter was continued, we find that Lot 20 and Lot 11, abutting along 31 feet of north west lot line, are merged for zoning purposes, being under common WBBO ownership. Accordingly, ground cover ratio and parking require- ments are satisfied between the two lots. The proposed entry vestibule, shown substantially to scale on C. Vallett's plot plan of 12/10/83, is set back in excess of the 20 -foot required front yard. 3. We find this non - conforming structure, substantially pre- existing zoning, may be extended or altered by addition of the entry vestibule with- out being substantially more detrimental to the neighborhood on the fol- lowing conditions: An elongated traffic barrier shall be properly installed and maintained along the front lot line proximate Surfside Road so as to provide a clearly defined entry and exit to the Muse. Design details are left to Applicants' determination in consultation with (006 -86) -2- the Traffic and Safety Committee and the Planning Board staff so as to improve the safe flow of traffic to and from the Muse. 4. Applicant indicated an intention to pave the parking area in front of the Muse and mark parking control lines. Suggestion was made that an area for patrons awaiting entry be marked off, e.g., by sidewalk from the parking area. Vestibule entry and exit doors are to be to either side, not front. 5. With the above stated condition, we further find that the proposed extension or alteration is in harmony with the general purpose and intent of the zoning code chapter. 6. Accordingly, this Board by UNANIMOUS vote GRANTS to Applicant a SPECIAL PERMIT to add such entry vestibule, subject to the above - stated condition.
