At a PLiblic Hearing of the BOARD OF APPEALS held on FRIDAY, JANUARY
L01 1935 at 1:30 p.m. in the Town and County Building, Nantucket, in the
matter of the Application of DAVID SAYR.E (005 -86), address 11 Weymouth
Street, Nantucket, MA 02554, the Board enters the following Decision and
makes the following findings:
i. Applicant seeks a SPECIAL PERi�IT under Zoning By -Law SECTION
139-33 to alter and extend Ln existing rlon- conforming structure, specifi-
cally to raise the height of a wall. located in the easterly side lot set -
back. The prerri_ses are located at 11 WEYMOUTH STREET, Lot 55.4.1., Plan 143
,nd zoned RESIDENTIAL- OLD - HISTORIC.
2. Based upon the Application papers, letters, viewings, testimony
and I1DC plans submitted at the hearing, we find that Applicant acquired the
prerises in January, 1984. The structure is, and was since prior to Zoning,
arranged and Lised as a duplex. In Appli.car;t's plan for improving the pro -
perty, the 5 prior bedrooms would be reduced to 3 bedrooms plus a loft as
the front dwelling unit, plus a studio apartment in the rear.
3. To earn,- out such plan , a rear, single- story, shed- roofed ex-
tension of the structure is to be replaced by a two -story addition, with
gable alined front -to -rear with the gable of the front dwelling unit. To
cover the existing foundation "ell" extending to the west, a single -story
addition goes to the west under a west- facing shed roof. Contrary to Appli-
carlt's proposal in the prior_ proceedings (our file 074 -85), Applicant here
proposes no increase in ground cover. Applicant here argues that raising
the 1-ieight of the east wall_ is undertaken to meet design requirements of
the historic District Commission. That presumably results from the scale
of Applicant's plans rather than any necessity. 1 h(a nort-confortnity

4. Nonetheless, the abuttor most affected appeared satisfied at the
}rearing that the new wall height and associated structure would not be
substantially more detrimental from his perspective. Notes from two others,
opposed, gave n<; particulars as to any negative impact. Testimony was
u rer_ed on Applicant's extended efforts to meet all zoning and HDC require-
ments. The Planning Board made no recommendation.
5. We accordingly find that Applicant's proposed alteration and ex-
tension within the easterly side line setback is not substantially more
detrimental to the neighborhood titan the existing non - conforming structure.
As shown on the plans dated December 10, 1985 by the HDC, the extension
of the structure will not increase the non - conforming distance. Relief
would be in harmony with the general purpose and intent of the zoning
chapter.
6. Accordingly, the Board by UNANIMOUS vote GRANTS to Applicant a
SPECIAL PERMIT to make the requested alterations and extension on the
east side in accordance with such plans.
