Sherman, Chairman BOARD OF' APPEALS BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: At a Public Hearing of the BOARD OF APPEALS held on FRIDAY, JANUARY 101 1986 at 1:30 p.m. in the Town and County Building, Nantucket, in the matter of the Application of CAROL CROCKER D /B /A THE THISTLE RESTAURANT (002 -86) address c/o 20 Broad Street, Nantucket, MA 02554, the Board enters the following Decision and makes the following findings: 1. Applicant seeks SPECIAL PERMIT under Zoning By -Law SECTION 139 -18G to confirm relief from any - parking requirements occasioned by past renovations of the Thistle Restaurant since Zoning, with no change of the use or the structure as they presently exist. The premises are located at 20 BROAD STREET, Map 42.4.2, Parcel 033 in the RESIDENTIAL - COMMERCIAL zoning district. 2. Based upon the Application papers, testimony and representations, as well as viewings, we find that Applicant has an existing restaurant operation, a conforming use in the R -C District. Prior to Zoning, the pre- mises were used as a single- family residence. 3. In 1978 when Applicant obtained the property and a first of their building permits, Applicant installed a restaurant use on the first floor retaining a residential use on the second floor. (That first building permit and the two later ones involved no exterior enlargement.) Despite the corresponding increase in the By -Law requirement for off- street parking spaces, relief from that requirement was not made a pre - condition for issuance of the 1978 building permit. Applicant %vers that neither she nor other predecessor owner were aware of the increased parking requirement corresponding to restaurant seating capacity. 4. With issuance in 1981 of the second building permit, the residen- tial second floor was structurally changed to expand the restaurant seating capacity. Again, no parking requirement nor awareness of it was invoked. (002 -86) -2- A 1985 building permit for reconstruction of an existing entry porch was similarly issued but involved no change in parking requirements. 5. Since 1978, Applicant's restaurant use has been pursuant to common victualers license and liquor license, annually renewed. Having pro- ceeded in good faith, Applicant here asks for relief from the parking requirement to the extent not grandfathered and still mandated despite the lapse of time without action taken. We can find only one space grandfathered. Whether or not action is barred as to parking required in connection with the 1978 level of restaurant operations, the requirement associated with the 1981 second -floor restaurant operation at legal capacity must be re- lieved or such operation cease. 6. No opposition to the requested grant of relief was heard. To the extent patio seating was introduced or enlarged in the last six years the Planning Board made an unfavorable recommendation. At the hearing, the patio was said, without contradiction, to date from 1978. Its legal capa- city would presumably be of record on the common victualers license though actual extent of use is not of record there or here. In any event, Appli- cant and any successor should be mindful that covering the patio or any intensification of use not of record may give rise to a new parking requirement. 7. Given the specific and particular circumstances of this case, the granting of the requested relief is in harmony with the general pur- poses and intent of the By -Law. Futhermore, the provision of off - street parking as would otherwise be required by the By -Law is physically impossi- ble for the Applicant to provide on the premises or, if practical, would have a significant and adverse effect on the scenic and historic integrity of the neighborhood. 8. Accordingly, the Board by UNANIMOUS vote GRANTS to Applicant the requested SPECIAL PERMIT under Section 139 -18G to confirm relief from any parking requirements occasioned by past renovations and alterations to the Thistle Restaurant since Zoning, without legitimatizing for zoning puposes any future change in use or structure as they prelsently exist.
