The Special Permit #(41 -78) granting permission to construct said cottage, specifically restricts the accessory dwelling from being, ". utilized as another guest house nor as a guest house annex. . ". Therefore, it is the order of the Inspector of Buildings that you cease the rental of the two aforementioned rooms immediately. Failure to comply with this order of the Inspector of Buildings will result in the revocation of the "cottages' " occupancy as provided in Chapter 139 -28(A) ( ) of the Codified By -Laws of Nantucket. BOARD OF APPEALS OF THE TOWN OF NANTUCKET APPEAL OF CLAIRE MURRAY SARVIS ) Claire Murray Sarvis, by her attorneys, pursuant to G.L. c. 40A, §8 hereby appeals to the Board of Appeals from the Order of the Building Inspector dated June 6, 1986, a copy of which Order is annexed hereto and made part hereof. The basis of the appeal is that the Building Inspector is in error in alleging that the accessory dwelling on the property at 27 Fair Street is being used as a "guest house." It is not being utilized as a guest house within the purview of the Nantucket Zoning By -Law. Moreover, even if it were being used as a guest house, it is a protected non - conforming use, and the Order of the Building Inspector is time barred under G.L. c. 40A, §7.
