Any appeal from this action shall be made pursuant to Section 17 of Chapter 40A of the General Laws, and shall be filed within twenty (20) days after this date. William R. Sherman, Chairman BOARD OF APPEALS BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: At a Public Hearing of the BOARD OF APPEALS held on FRIDAY, DECEM- BER 13, 1985 at 1:30 p.m. in the Town and County Building, Nantucket, in the matter of the Application of ERNEST B. LATHAM AND CHAILLE LATHAM (112 -85), address 45 Prides Crossing, New Canaan, CT 06840, the Board enters the following Decision and makes the following findings: 1. Applicants seek a VARIANCE under Zoning By -Law SECTION 139 -16C to cure an error in siting a single- family residence too close to the west side lot line. The premises are located between MILK STREET to the south and GREEN STREET (or Lane) to the north, 1 "Ircel 'S'O (d 43.3.3 in the RESIDENTIAL -OLD- HISTORIC district. 2. From the Application papers and representations of counsel for Applicants at our hearing, it appears that the two -story residence was in- advertently constructed too close to the west side lot line. The error arose by a setting of batter boards measured from a neighbor's fence rather than from a surveyed lot line. The error became apparent in connec- tion with other matters relating to the construction and after corner boards, etc., were in place extending toward the side line beyond the foundation. 3. According to a plot plan dated October 10, 1985, the north corner is 0.03 feet into the side line setback and the south corner 0.13 feet. Ordinarily, such insubstantial invasions of a 5 -foot setback would not reach this Board. In any event, the Building Inspector and Planning Board recommend favorable action as does one abuttor, and no opposition was heard. The error can be physically cured only by removal of finished construction. 4. Obviously, Applicants face a substantial hardship, both financial and practical. The shape of the lot is somewhat unusual in having street frontage on both north and south ends, narrow relative to the north -to- south length. (112 -85) -2- 5.
