Sherman, Chairman BOARD OF APPEALS .k� BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: At a Public Hearing of the BOARD OF APPEALS held on FRIDAY, DECEM- BER 13, 1985 at 1:30 p.m. in the Town and County Building, Nantucket, in the matter of the Application of WILLIAM J. AND ROSALIND CARPENTER (111 -85) address 1307 35th Street, NW, Washington, DC, the Board enters the follow- ing Decision and makes the following findings: 1. Applicants seek a SPECIAL PERMIT under Zoning By -Law SECTION 139 -33 to extend and alter a pre- existing non - conforming single - family residence. The premises are located in QUIDNET on NORCROSS ROAD per Land Court Plans 8606 -B and F, Lots 9 and 10A, in the RESIDENTIAL -2 zoning district. 2. Based upon the Application papers and drawings, testimony and representations received at our hearing, it appears that the residence pre -dates Zoning. Even with legal merger of open Lot 10A with Lot 9, the total area 9,035 SF is far below minimum lot size of 20,000 SF. i'1aximum ground cover is 1500 SF, well above that reckoned at 12.5% of 9,035 SF, but existing ground cover is 1420 SF for dwelling, 70 SF for porch plus 209 SF for detached garage, i.e., 1699 SF or 199 SF in excess. The proposed 132 SF addition across the west end of the residence would accommodate a bathroom between enlarged bedrooms, limited to a first story under shed roof. This apparent excess is greatly ameliorated by common ownership of contiguous beach lots technically not merged because of interposition of paper road "Sesachacha ". 3. Quidnet is a village of similar small homes on undersized lots rendered charming by varieties of such small additions. A long -term resident contacted by members of the neighborhood found they had no ob- jection once appr ised by him of the addition proposed. His testimony, without any opposition, supports our finding that the proposed extension and alteration would not be substantially more detrimental to the neighbor- hood than the existing,-non-conforming use. They are in harmony with the (111 -85) -2- general purpose and intent of the zoning chapter. The Planning Board's recommendation was unfavorable, apparently absent awareness of the beach lots in common ownership. The appropriateness of variance relief is not apparent. 4. Accordingly, the Board by UNANIMOUS vote GRANTS to Applicants the SPECIAL PERMIT to alter and extend their residence as described, con- ditioned, however, upon Applicants' completing and making of record the covenant to legally merge Lots 10A and 9 as they undertook in filing this Application.
