DECISION:
At a Public Hearing of the BOARD OF APPEALS held on FRIDAY, DECEM-
BER 13, 1985 at 1:30 p.m. in the Town and County Building, Nantucket, in
the matter of the Application of PHILIP W. AND MARGARET G. READ (110 -85)
address 14 Sherburne Turnpike, Nantucket, MA 02554, the Board enters
the following Decision and makes the following findings:
1. Applicants seek a SPECIAL PERMIT under Zoning By -Law SECTION
139 -33 to expand a pre- existing, non - conforming structure, namely, the
DANIEL WEBSTER HOUSE, plus relief by SPECIAL PERMIT from any further off -
street parking space requirements, as provided in SECTION 139 -18G. The
premises are located at 27 BROAD STREET, Lot 78, Plan 4242, in the RESI-
DENTIAL- COMMERCIAL zoning district.
2. Relying on the Application papers, testimony and representations
at our hearing, we first considered whether this Board has jurisdiction.
As amended (4/3/85 ATM), Section 139 -9 B(4)(a) defines Major Commercial
Development ( "MCD ") and includes a final paragraph concerned with "grand -
fathering". Subsection (b) places sole authority in the Planning Board
for MCD Special Permit grants. Absent grandfathering, the Daniel Webster
House alone and together with the contiguous and commonly owned J,lred
Coffin House has guest rooms and area of commercial use to constitute an
MCD. However, any increase since the April 1979 introduction of the MCD
By -Law Section would not qualify this Application for Planning Board juris-
diction. We recognize that "contiguous" has a secondary, broader meaning,
i.e., "in close proximity without actually touching; near." That may or
may not require inclusion of guest houses acquired after April 1979, by
Applicants across Centre Street. Considering the nature of Applicants'
proposed expansion, the unqualified favorable recommendation of the Plan-
ning Board and absense of any opposition here, this case seems inappro-
priate for seeking a legal delineation of the scope to be given "contiguous

tracts" in the MCD definition. We assume jurisdiction.
3. Applicants propose a stairwell enclosure of 13'x28' footprint,
the structure extending up the rear facade. Provision would thus he made
for various non- revenue functions, namely, for storage, a new furnace room,
employee showers and audio - visual training room. Reckoning the parking
requirement from Section 139 -18I, these uses reflect no increase in rental
units nor parking space increase in any other category so far as appears
on the record. Fairly, the Application benefits from the ruling in the
recently- decided Tavern Case interpreting Section 139 -18A so as not to
require additional off - street parking here. We are-told that 21 spaces are
now provided, with 58 rental rooms on the two adjacent premises. They are
non - conforming (as well as pre- existing) as to bring the present Applica-
tion within Section 139 -33.
4. We accordingly find the proposed extension and alteration not
to be substantially more detrimental to the neighborhood than the existing
non - conforming use. Rather, they are found to be in harmony with the
general purpose and intent of the zoning chapter. No distance is made more
non - conforming.
5. Whereupon, the Board by UNANIMOUS vote GRANTS to Applicants the
requested relief by SPECIAL PERMIT for such structural extension and
alteration.
