DECISION:
At a Public Hearing of the BOARD OF APPEALS held on FRIDAY, NOV-
EMBER 22, 1985 at 1:30 p.m. in the Town and County Building, Nantucket,
in the matter of the Application of MICHAEL J. AND JANICE M. DAVIS
(103 -85) address 54 Lover's Lane, Nantucket, MA 02554, -the Board finds:
1. Applicants seek a SPECIAL PERMIT under Zoning By -Law SECTION
139 -7C to install an Accessory Apartment in their single - family home.
The property is located at 54 LOVER'S LANE, Lot 1 on Page 29, Plan Book 17,
in the LIMITED USE GENERAL -2 zoning district.
2. Based upon the Application papers, testimony, representations,
letter and plans, we find that Applicants now have only one dwelling
unit on the property, their single- family home. They propose expanding a
single -cr garage, now attached to the house, by constructing a one -story
14' x 28' addition and installing an Accessory Apartment in the result-
ing 28 x 28 foot space. The apartment, one -story only, will thus replace
the garage. The garage door will be replaced with an HDC- approved picture
window.
3. Applicants' lot at the intersection of Lover's Lane and Maclean
Street, a 'paper' road, is,;with only 28,968 SF, undersized, 80,000 SF
being the minimum required in LUG -2. While the lot may be 'grandfathered'
with respect to a recent Board of Health requirement of 40,000 SF per
septic system, we expressed concern that the Accessory Apartment not
require an additional septic system, and were so assured.
4. No objections were heard. The Planning Board's recommendation
was favorable. Applicants understand and will comply with all the condi-
tions of Section 139 -7C.
5. Accordingly, the Board by UtiANIMOUS vote, hereby GRAti1 to
Applicants a SPECIAL PERMIT to install an Accessory Apartment in the
(103 -85)

attached garage, as proposed, provided no additional septic system is
required and provide, - -d that the apartment is strictly in accordance with
Section 139 -7C in its structure and use.
