DECISION:
At a Public Hearing of the BOARD OF APPEALS held on FRIDAY,, NOV-
EMBER 8, 1985 at 1:30 p.m. in-the Town and County Building, Nantucket,
in the matter of the Application of DONN O'CONNELL and EILEEN R.
O'CONNELL (097 -85), address 24 Pelton Street, West Roxbury, MA 02132,
the Board finds:
1. Applicants seek a VARIANCE from Zoning By -Law SECTION 139 -16
to validate undersized LOTS 32A and 32B (Plan Book 20, Page 51) as
separately marketable despite the minimum lot size requirements of the
intensity regulations. The property is at 57 EASTON STREET in the
RESIDENTIAL -1 zoning district.
2. Based upon the Application papers and testimony and repre-
sentations including those of Applicant Donn O'Connell, we find that
Applicants acquired Lot 32B on December 5, 1980. Apparently without
proper counsel they then acquired adjoining Lot 32A on July 20, 1981
in their same names. The Lots, which were subdivided ANR June 12, 1978,
thus became legally merged for zoning purposes. Given the premise of the
Planning Board's favorable recommendation, however, Applicants have
a statutory entitlement (Ch. 41 MGL Section 81P) to separate lots each
with a pre -1955 structure.
3. In similar cases, we have granted a variance upon finding that
the dwelling on each lot did indeed predate 1955. The evidence here was
not as compelling as we would prefer; however, there was heard no
opposing evidence or representation.
4. According to Applicants, the guest house on Lot 32B fronting
on Easton Street dates from 70 to 80 years ago. The cottage on Lot 32A
fronting on Cornish Street was constructedprior to 1955, possibly modi-
fied since that date and prior to the 1972 effective date of Zoning to
its present form and use.

6. This is not an instance where a subdivider failed to act in
a timely manner to achieve separate marketability but simply of ill -
advised purchasers who would face considerable financial hardship ab-

No adjoining land can be bought to cure the shortfall.
7. Neither lot is appropriate for any addition to ground cover
or upward expansion. We would condition relief on a bar to future in-
crease of ground cover or floor area.
8. Accordingly, the Board, by UNANIMOUS vote, GRANTS to Applicants
the requested VARIANCE with respect to SECTION 139 -16 solely to validate
separate marketability of Lots 32A and 32B -and subject to the condition
stated above.
