Sherman, Chairman BOARD OF APPEALS BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: At a Public Hearing of the BOARD OF APPEALS held on FRIDAY, OCT- OBER 18, 1985 at 1:30 p.m. in the Town and County Building, Nantucket, in the matter of the Application of MARY L. REITH (092 -85), address 33 Bartlett Road, Nantucket, MA 02554, the Board finds -: 1. Applicant, pusuant to Application papers filed by her tenant William H. Reith, seeks to relocate and to install enlarged gasoline storage tanks and dispensing pumps as a "gas station" on premises lo- cated at 12 WASHINGTON STREET, Lot 143, Plan No. 4231 in the RESIDENTIAL - COMMERCIAL zoning district. The relief sought is by SPECIAL PERMIT under Zoning By -Law SECTION 139- 9B(3)(d) with favorable finding under Section 20A. 2. Based upon the Application papers, viewings, testimony and representations and absent any objection, we find that siting of two pairs of dispensing pumps as shown, together with the indicated storage tanks and service building, will be in harmony with the general pur- pose and intent of the Zoning By -Law chapter. We are assured by Appli- cant and her tenant, with confirmation of the Building Inspector's office, that all fire and safety requirements, and those concerning underground petrochemical storage and surface storage and disposal of hazordous and other waste material, will be complied with and com- pliance maintained during use of the gas station. This further supports our specific finding that Section 20A will not be violated. 3. Doing business as Island Motors just to the north of the proposed site since prior to the effective date of Zoning, the Reiths are now undertaking to upgrade their property in functionality and aesthetically, at the same time enhancing traffic safety. The Planning Board's recommendation is favorable. 4. Accordingly, this Board, by UNANIMOUS vote, hereby GRANTS to i (092 -85) -2- Applicant the SPECIAL PERMIT requested for a gas station use in accord- ance with the site plan and conditioned on compliance with applicable requirements for waste oil storage and disposal.
