Prior to the purchase of the premises, the Applicant and
his wife, Mildred H. Boynton, had for several years owned property
in Quaise which they had occupied as their year -round resi_den:_;e.
In the course of resolving Tnarital difficulties which had
arisen between 1,1r. and Mrs. Boynton, the Quaise property was sold
in 1983.
Thereafter, and as part of the reconciliation of the Applicant
and his wife, the premises were purchased as vacant land with the
intent of constructing a dwelling 'house thereon to serve as their
rersonal year -round residence.
Accordingly on March 6, 1984 the Applicant executed a Covenant
to the Town of Nantucket pursuant to the provisions of the Zoning
By - -Law, Sec. 7C, 1, f (Document No. 292.)0 on Certificate of Title
No. 11,050, Nantucket Registry Di strict for the Land Court) .
Thereafter a Building Permit was duly issued and a dwelling house
was constructed at the premises.
It became apparent, however, that the marital reconciliatior.
of Mr. and Mrs. Boynton could not be effected while residing cn
Nantucket. In order to further their reconciliation it was decided
to remove from the Tsland and establish their residence on the
mainland. To this end, they purchased their present. residence in
Connecticut during the summer of 1984.
The dwelling house at the premises was completed. during the
winter of 1984 and has remained unoccupied ever since.
The Applicant and Mrs. Boynton, having established their
new residence in Connecticut for the sake of preserving their
marriage, now find themselves faced with the personal hardship
of owning a property which they can no longer use for the purpc,es
originally intended and which, accordingly, they wish to sell.
The Covenant now imposes a substantial financial hardshilp
upon the Applicant inasmuch as it restricts the available mE +sket
for sale of the property, eliminating the seasonal residents
who would be willing and able to pay the fair market value.
The Applicant therefore requests the issuance of a Spec.Lal
Permit. under Sec. 7C, 1j of the Zoning By.-Law granting re'Lief
from the said Covenan' -.
