DECISION:
At a Public Hearing of the BOARD OF APPEALS held on FRIDAY, OCT-
OBER 18, 1985 at 1:30 p.m. in the Town and County Building, Nantucket,
in the matter of the Application of THERESA M. SMITH (088 -85), address
Somerset Road, Nantucket, MA 02554, the Board finds:
1. Applicant seeks a SPECIAL PERMIT Under Zoning By -Law SECTION
139 -7C92) allowing her to construct an Accessory Apartment in her exist-
ing single - family home. The property is located at the corner of DOC
RYDER DRIVE AND SOMERSET ROAD, fronting ob Somerset,Lot 106, Plan 28933 -
M in the RESIDENTIAL - COMMERCIAL zoning district.
2. From the Application papers, representations and testimony,
we find that the existing house can appropriately accomodate an Acces-
sory Apartment of about 700 SF conforming with all the conditions of
Section 139- 7C(2). The exterior entry to the Accessory Apartment is
from the side off Doc Ryder Drive, a driveway there providing a second
off - street parking space. No secondary dwelling is or should be on the
site, the connection to the principal dwelling not conforming with
Section 139- 7A(3)(b), see definition of "Breezeway ".
3. Applicant intends to record with her deed the year -round oc-
cupancy restriction of Section 139- 7C(2)(g), putting her proposed use
in harmony with the general purpose and intent of the Zoning By -Law
chapter, conditioned only on her continuing compliance with all the
conditions of Section 139- 7C(2).
4. The Planning Board's recommendation was favorable except for
one negative vote. Since the Accessory Apartment will have only one
bedroom where two bedrooms were planned in the design of the septic
system, that negative vote might have been obviated.
5. Accordingly, the Board, by UNANIMOUS vote, hereby GRANTS to
Applicant the requested SPECIAL PERMIT subject only to the condition
noted above.
