In the matter of the Application of RUSSELL A. SIBLEY and
JOAN L. SIBLEY (087 -85), at a meeting of the BOARD OF APPEALS
held at 1:30 P.M. on Friday, November 8, 1985, at the Town and
County Building, Nantucket, the Board enters the following Decision
and makes the following findings:
1. This is an application for a SPECIAL PERMIT granting
relief from the requirements of Nantucket Code, SECTION 139 -16.A
(Intensity Regulations - Ground Cover Ratio) , a portion of the
Zoning By -Law, on the basis of expansion of a preexisting
nonconforming structure pursuant to SECTION 139 -33. If granted,
the Applicants would be permitted to construct an addition to
their existing dwelling, which would then exceed the permitted
ground cover ratio of 30 %. The subject premises consist of the
property approximately shown on Assessor's Map 42.3.1 as Parcel
101, are located at 9 UNION STREET, and are zoned as RESIDENTIAL -OLD
HISTORIC.
2. Based upon the application and the materials and testimony
presented at the public hearing, the Board finds that the subject
premises consist of a parcel of land containing about 3,600 square
feet, containingapYe-existing dwelling, which, although a permitted
use, is not in conformity with the required setback requirement
of five feet from its side boundary along Stone Alley. The
present ground cover ratio of the existing structure is 27.40;
the proposed addition would increase that ratio to 33.5°x. The

permitted ground cover ratio in the district is 40%, but because
the lot contains less than 5,000 square feet, the maximum permitted
(under Section 139 -16.A, Notes) is 300.
3. This Board finds that the proposed addition (which
represents a substantial reduction from the proposal as contained
in the original application) will not be substantially more
detrimental than the existing nonconforming structure to the
neighborhood in that there will be no significant visibility of
the addition from any street or nearby parcels of land. The
Applicants' structure is a relatively small, historic house, and
the addition will enhance the utility of the living space in the
house. Many other nearby parcels contain structures with
substantially greater size and ground cover ratios. The Board
further finds, for the same reason, that the proposed addition is
in harmony with the general purpose and intent of the Zoning Act
and the Nantucket Zoning By -Law.
4. The relief granted hereby is upon the condition that
the proposed addition shall not increase the ground cover ratio
of the subject premises above 33.5%, and that it shall be constructed
upon the southerly side of the present structure as shown upon
the revised plans submitted to this Board at the continued public
hearing.
5. For the reasons and upon the condition set forth, the
J3QARD Off' APPEALS hereby GRANTS the Applicants relief from the
Zoning By -Law, Nantucket Code, Section 139 -16.A, increasing the
permitted ground cover ratio to 33.50, by a SPECIAL PERMIT, by a
UNANIMOUS VOTE.

AMENDMENT TO SPECIAL PERMIT
In the matter of the Application of RUSSELL A. SIBLEY and
JOAN L. SIBLEY (087 -85), upon request by the Applicants, the
Decision of the BOARD OF APPEALS filed on November 22, 1985,
granting a Special Permit., is hereby amended and modified as
follows:
(a) The present ground cover ratio is found to be 26.4°x,
and the maximum ground cover for the premises after construction
of the proposed addition shall be 34.3 %.
(b) The proposed addition should be built in accordance
with the revised plan submitted to the Board, a copy of a portion
of which, reduced in scale, is attached hereto as Exhibit A.
The Board finds that the matters contained in this Amendment
are technical corrections rather than substantive changes, and
accordingly that no public hearing nor notice is required in
connection herewith.

COUNTY BUILDING, FEDERAL AND BROAD STREET, NANTUCKET, on the
Application of RUSSELL A. SIBLEY and JOAN L. SIBLEY (DV_ -85),
seeking a VARIANCE under Nantucket Code §139 -16.A (Intensity
Regulations - Ground Cover Ratio) . If granted, the applicants
would be permitted to construct an addition to their existing
dwelling, increasing the ground cover ratio to 40.3 %; the maximum
