At a Public blearing of the BOARD OF APPEALS held on FRIDAY,
SEPTEMBER 13, 1985 at 1:30 p.m. in the Town and County wilding, Nantucket,
in the matter of the Application of JOHN K. AND COLLEEN ARNO (dba Vincent's
Restaurant) (083 -85), address 30 Woodlane Road, Lawrenceville, NJ 08645,
the Board finds:
1. Applicants seek a SPECIAL PFRMI"T" under SECTION 139 -33 to extend
and alter an existing, non - conforming, structure known as Vincent's Restau-
rant:.. Ralief by VARIANCE is n1so sounht. The property is located at 2
SOUTH WATER STREET, Assessor's Yap 43.4.2, Lot 102, Plan Book 136, Page
547, Lot 1 on Ulan of John J. Shun?uw dated 3/21/S5. It is in the RFSI-
DENCIAL- COMMERCIAL zoning district.
2. Based upon the _Application papers, testimony and representations
as well as site and floor plans received at our hearing of September 1.3,
1985, and viewings, we find that the premises are the subject of our
Special Permit granted February, 1984 and extended in 1985 for 6 months,
allowing expansion of restaurant use with a second -floor dining, room. the
present request is to improve stairway arrangements for second -floor
access, also to accomodate on -site storage.
3. Storage has been in an off -site shed near the southeast corner
of the restaurant. That shed as well as a restaurant patio is located on
Land of Sherburne Associates, now of Peter Burns. By instrument of record
in the Registry of Deeds, the lot line between Applicants' lot and Sher -
burne's was turned counter- clockwise to run perpendicularly to the front
tot line along South Later Street. Applicants undertake to remove the
storage shed anti here seek rFeDlacement space eneath the proposed stairways.
4. An existing exterior stairway to the second floor is now on the
sou; A side of the reed Durant (next to Lne Rose and Vrown). - -Being two --
narrow, it is to be replacad by the two stairways, front and rear, on the
south side. With these
stai.rways and storage below, Applicants propose
a

Rose and Crown and Sunken Ship to the north however, no front yard set-
back is required. A resultant improvement in the front facade i -s thus
proposed along with provision of proper stairways and storage.
5. No opposition was heard. The Planni.n., Board's recom;nendati_on
was favorable (atthouz;'n this structural entac r _:`Iii'>nt rlvolr'es the off - treet
parking requirement, Section 139 -18A, other.wi se :;rrindf ath, red or rle, -ttt
with in the 1984 Special Permit). In particular, the abuttor to the south
lot line voiced no objection to substantialli' no setback along most of
that lot line. The abuttor_'s lot accomodates Applicants' Leased patio
space and some vehicle storage. Prospective future use is not of record.
Thus, we are not faced with anv issue of light and air, emergency use, or
public benefitting from the space Applicants propose to cover. In fact,
the removal_ of the northerly stairway adds to overall safety and affords
better access for the proposed construction to he undertaken there.
6. We find that the restaurant pre - dates the 1972 effective date
of "Zoning, that the proposed extension and alteration will not be substan-
tially more detrimental to the neighborhood than the existing non- conform-
i.ng use and that they are it-) harmony with the general_ purpose and intent
of the Zoning By -Law chapter.
7. To the extent that the proposed southerly extension of the
huilding and the in the souther[v l(-,t l inc require relief beyond
that available by Special Permit under- Section 1:39 -33, e.g., because of
i- ncreasing the vi.olat i n of the side 1 [it- distance, Applicants
request and require a Vari -:n, -t for full i-1 i '.;ith reshaping of the Lot
to iiiinrove its regularity ano to , et Bt!-' I it ode requirements for
second - door dining use, only sucn c,>fie' obviate a hardship. Such
relief may be granted without Nullifying or sur,stantially derogating from
the intent or purpose of the Zoning By -Law chapter and without substantial
detriment- to-- t-he- public good. _
