PATERSON (080 -85) Enclosed, please find notice of a decision of the BOARD OF APPEALS which has this day been filed with the Tovn Clerk. Any appeal from this action shall he made pursuant to Section 17 of Chapter 40A of the General Laws, and shall be filed within twenty (20) days after this date. c/ William R. Sherman, Chairman BOARD OF APPEALS BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: At a Public Hearing of the BOARD OF APPEALS held on FRIDAY, SEPTEM- BER 13, 1985 at 1:30 p.m. in the Town and County Building, Nantucket, in the matter of the Application of ARNOLD W. AND DORIS L. PATERSON (080 -85), address 23 Golfview Drive, Nantucket, MA 02554, the Board finds: 1. Applicants are undertaking to construct a new single - family residence on FRIENDSHIP LANE, Assessor's Map 56, Parcel 350, Lot 53, Land Court Plan 35397G in the RESIDENTIAL -2 zoning district. They seek here a SPECIAL PERMIT under Zoning By -Law SECITON 139 -7C to install an 800 SF accessory apartment in the residence concurrently with its construction. 2. With the Application papers, including the Assessor's Map, site plan and elevational views, is a floor plan showing disposition of the proposed accessory apartment in the westerly extending wing of the single - story structure. At our hearing September 13, 1985, we were assured that the apartment, as shown, conformed in all particulars to the requirements of Section 139 -7C. 3. Specifically, Applicant Paterson explained that the house side labeled "Front Side" on the floor plan actually will face south parallel to the street. The two doors spaced about 24 feet apart on that side will not give the appearance from the street of a duplex, contrary to sub- section (2)(c). Instead, the westerly door entering the living room of the apartment will appear the main entrance. (A second, west - facing en- trance off the same deck as the "main" door is set back mid -way of the house to enter the main dining area.) 4. In any event, Applicants understand that their plans for pur- poses of a building permit and as constructed must comply in all respects with Section 139 -7C. Relief here is so conditioned. 5. No opposition was heard. The Planning Board's recommendation is favorable. (080 -85) -2- 6. Accordingly, this Board, by UNANIMOUS vote, hereby GRANTS to Applicants the requested relief by SPECIAL PERMIT pursuant to Section 139 -7C and subject to full compliance with all provisions of that Section.
