ROCK AND CATHERINE ROCK (078 -85), address 14 Deer Run Road, Box 2134, Nantucket, MA 02554, the Board finds: 1. Applicants seek a VARIANCE from Zoning By -Law SECTION 139 -7C and specifically SUBSECTION 2(a) to complete installation of an oversized accessory apartment within their single - family house. The property is lo- cated at 14 DEER RUN ROAD, Lot 20 on Land Court Plan No. 33861 -H, in the zoning district LUG -2. 2. Based upon the Application papers, viewing, testimony of Mr. Rock and the favorable reccomendation of the Planning Board, we find that the proposed accessory apartment installation would be completed above an existing attached two -car garage of floor area 1118 SF. Usable area of X38.50 SF cannot appropriately he reduced except by im,:ard placement of one or both knee walls which would restrict air and light or similarly impracticable relocation of an end wall. The 800 SF per By -Law limitation is substantially less than 40% of the house's gross floor area. 3. The proposed minimal oversizing of the accessory apartment is thus in substantial conformity with the By -Law Subsection. 'the sought relief may be ;ranted without substantial detriment to the public good and without nullifving or substantially derogating from its intent or purpose of the By -Law. Due to the noted circumsrances regarding shape, not general- ly affecting other LUG -2 properties but affecting Applicants', literal en- forcement of the 800 SF area provisions would involve substantial hardship, financial or otherwise, to Applicants. 4r-4ccordin -gly, the Board, by UNANIMOUS vote, GRANTS to Applicants a VARIANCE which in addition to SPECIAL PERMIT relief under SECTION 139 - 7C(2)'would allow them to complete installation of the accessory apartment, ( 078-85) as proposed. -2- Dated: September 6, 1985 Nantucket, MA 02554 IUA-b L) 9 FjlvN William R.
