DECISION:
At a Public Hearing of the BOARD OF APPEALS held on FRIDAY, SEPTBM-
BER 13, 1985 at 1:30 p.m. in the Town and County Building, Nantucket,
in the matter of the Application of ROBERT AND MELODY CORNOG AND FLORENCE
ZOLAN (075 -85), address 68 West Mechanic Street, New Hope, PA 18939, the
Board finds:
1. Applicants seek a VARIANCE
for relief from an alleged defect in
ANR subdivision into two lots not co
ments. The property is located at 9A

2. Based upon the Application papers, testimony and representations
at our hearings of August 23, 1985 and September 13, 1985, and viewings,
we find that Lot 2 has about 1284 SF where 5000 SF are required by Sec-
tion 139 -16. Lots 1 and 2 were created by Applicants' undertaking a sub-
division pursuant to Chapter 41 MGL Section 81P. The plan was endorsed
by the Planning Board 12/27/82 with approval not required ( "ANR") in
accordance with the definition of a "subdivision" in Section 81L.
3. Subsequent to that ANR subdivision and without prior variance
grant, Applicants sold off Lot 1 with about 2170 SF and 37.43 foot frontage.
4. At the common boundary of Lots 1 and 2 off Warren Street, two
adjacent parking spaces are provided on respective sides of the boundary.
Having thus satisfied the parking requirement, Applicants here seek a
variance only with respect to minimum lot size.
5. Each of Lots 1 and 2 had and now have a pre -1955 single - family
residence sited to be non- conforming with respect to side line setback,
east and west respectively. The structures on Lots 1 and 2 accordingly
(075 -85) -2-
preceded the 1955 adoption here of the Subdivision Control Law. In similar
past cases, this Board has generally granted variance relief where there
has been no indication of an intent to enlarge the structures or intensify
the use. Applicants here state that "no expansion of the building is
requested."
6. Applicants are undertaking limited renovation, primarily of the
substandard rear portion of the Lot 2 cottage, where the structure is
closest the easterly side lot line. At the August 23 hearing, Board con-
sideration was given to conditioning relief upon compliance with the Mass-
achusetts Building Code. Absent broader support for this from the office
of the Building Inspector, the condition was reduced to compliance with
Code Section 303.2 (9/1/80) in the easterly wall of the structure to the
extent within the specified distance from the lot line.
7. Counsel for Applicants, in an undated memorandum we received
9/4/85, cited Weld v. Board of Appeals of Gloucester, 345 Mass 376, 187
NE 2 d 854 (1963), opposing a broader condition. In that case, condition
6 required that "inside construction shall be in accordance with the plans
filed, and the building code," (emphasis added). The Supreme Judicial
Court specifically found condition 6 without fault in deciding the case
with respect to other conditions in favor of the Applicant there. Accord-
ingly, our limited condition appears valid.
8. The Planning Board's recommendation was unfavorable. In response
our Board will consider early adoption of a policy of applying, propective-
ly and strictly, the law governing variances in cases such as this invol-
ving ANR creation of non - conforming lots with respective pre -1955 residences.
See Alley v. Building Inspector of Danvers, 354 Mass6 (1968); also Arrigo
v. Planning Board of Franklin, Mass. App. Ct. Adv. Sh. 2101 (1981) dis-
cussed in "Land Use Manager" Vol. 1, Edition No. 9, September, 1984 where
insufficient frontage was fatal to an ANR subdivision Applicant's variance
relief.
9. This Board, by UNANIMOUS vote, hereby GRANTS to Applicants a
VARIANCE with respect to the submission size of Lot 2, subject to prior
compliance with Code Section 303.2 as above stated.
