A Public Hearing of the BOARD OF APPEALS will be held on
FRIDAY, AUGUST 2, 1985 at 1:30 p.m. in the TOWN AND COUNTY BUILDING,
FEDERAL AND BROAD STREETS, NANTUCKET, on the Application of MARGARET
C. CURLEY, JANE B. MILLER AND CHARRON P. RANNEY for themselves and
GEORGE E. SYKES III AND JANE BUCKLEY SYKES, OWNERS (070 -85) seeking
a SPECIAL PERMIT under SECTION 139 -33.A (extension of a pre - existing
non - conforming use) and under SECTION 139 -22.H (Employer Dormitory)
and a VARIANCE under SECTION 139 -18 (parking requirements) of the
Zoning By -Law. If granted, Applicants would be able to convert
existing space within a food store to use as a kitchen and would be
able to provide employee housing in the rear of the building. With
the alteration of said building Applicants would also be relieved of
the parking spaces required by suc,i an alteration. The property is
located at 49 PLEASANT STREET, ASSESSOR'S PARCEL 55 -19, LOT 2, PLAN
FILE 16 -A and is zoned RESIDENTIAL -1.

Applicants' Statement
This application is made by Margaret C. Curley, Jane B.
Miller and Charron P. Ranney, as the prospective purchasers,
under a purchase and sale agreement dated April 17, 1985, between
George E. Sykes III and Jane Buckley Sykes as Sellers and Margaret
C. Curley as Buyer (the applicants having been designated as
nominee by the Buyer named therein) , of the premises at 49 Pleasant
Street, Nantucket (Assessor's Parcel 55 -19) , shown as Lot 2 upon
a plan recorded with Nantucket Deeds in Plan File 15 -A. The
premises consist of a parcel of land containing 4,773 square
feet, with an existing wood frame store building thereon. Said
building has been used in the past as a grocery and convenience
store, for sale of foodstuffs and other merchandise, including
sandwiches and other prepared foods not to be consumed upon the
premises, under the name of Pleasant Street Variety. Such use
pre - exists the adoption of the Nantucket zoning by -law in 1972
and has continued up to the summer of 1984, and therefore constitutes
a pre- existing non - conforming use. The premises lie within a
Residential -1 zoning district.
The applicants intend to use the premises as a grocery
and convenience store, including sale of prepared foods not to be
consumed upon the premises, as heretofore used. The only changes
in their proposed use of the premises from its prior non - conforming
use consist of (a) conversion of existing space within the building
for use as a kitchen, to be used in baking and cooking of foods

to be sold for consumption away from the premises, and (b) conversion

of existing space in the of the building for use as
an employer dormitory as living quarters for the applicants'
employees.
The applicants seek relief as follows:
1. They request a special permit for extension of the
pre - existing non- conforming use under Nantucket Code §139 -33.A,
for conversion of existing space to use as a kitchen auxiliary
to the prior non - conforming use as a food store.
2. They request a variance from the parking requirements
of the by -law under §139.18,Under the by -law, any change in use
triggers a requirement that the full number of parking spaces
required for all uses upon the premises, including existing uses,
be provided. The applicants compute the full number of parking
space.P required as seven determined as follows:
Store premises: 516 square feet;
one parking space required
for each 200 feet of gross
floor area 3
One additional space for each
three employees 1
Employee dormitory 3
Total 7
In fact, the physical dimensions of the premises and the existing
building thereon enable the applicants to provide four parking
spaces in line in the driveway and one in the garage; because
these spaces are all in line, they do not comply with the dimensional
requirements for parking spaces set forth in the by -law. Therefore,
the applicants request that they be granted a variance from parking
requirements as aforesaid, and that they be required only to
provide parking spaces for four cars, not complying with the

3. They request a special permit for an employer dormitory
under §139 -22.H, to enable occupancy of the
