Applicants seek a VARIANCE under the following SECTIONS of the By -Law chapter_: - 139 -7 /A (2)(d), secondary dwelling to comply, iter alia, with side and rear lot line setback and lot to have required frontage and two off - street parkin; spaces; - 139 -16'a and C and 18, directly and as incorporated by re- ference in the above Sections; - 139 -27. building cap limiting rate of development; hence, delaying issuance of a Certificate of Occupancy; and /or a SPECIAL PERMIT under ShCTION 139 -33 for altering or reconstructing a pre-existing non - conforming use or structure. 2. The property is located at 61 FAIR STREET, Lot 0126, Plan No. 55.4.1 in the RESIDENI'l'll, OLD 111STORIC Zoning District. Applicant acquired the property with the principal dwelling and a barn sited at the rear and bounded by the rear and side lot lines with no setback. Besides alterations to the principal clwel.li.n ;, :App:Licant reconstructed the barn, said now to be on a smaller more conforming t_ootprint, presumably still within the required setbacks. The Building Inspector required a cease and desist of oct:,up, -MC y and use from that date. (06.8 -85) -2- 3. No provision for off- street parking has been made. Applicant notes that an apartment constructed in the principal i�,,elling about 1980 or 1981 has been removed and that off - street parkin: i not so needed at that end of Fair Street. 4. Letters of other parties, except one, are favorable and indicate Applicants to be good neighbors in undertaking these changes. We find, therefore, the changes of structure from barn to guest quarters with bed- room and bath (but no kitchen cooking or eating facilities) not substan- tially more detrimental to the neighborhood than the pre - existing barn. Since, such guest quarters, like the barn, are permitted uses accessory to the principal dwelling, a Special Permit for that altered use is inappro- priate. 5. We find that the proposed secondary dwelling use would be sub- stantially more detrimental to the neighborhood, not only in intensity of use but also in requiring such extensive variance relief as to nullify or substantially derogate from the intent and purpose of the By -Law chapter. The Planning Board's recommendation likewise was unfavorable. 6. Accordingly, by UNANIMOUS vote, the Board hereby GENIES the re- quested VARIANCE snd SPECIAL PERMIT relief requested to allow a secondary dwell..i.n, use but GRANTS to Applicant a SPECIAL PERMIT validating; the re- construction or alteration of the barn to the present guest quarters structure conditioned on Applicant removing the kitchen (e.g. Pullman unit) and not making any use of the structure for cooking or eating.
