BRUCE M,ACGREGOR, TRUSTEE OF NANTUCKET SUN NOMINEE TRUST (067 -85), address Robinson Road, P.O. Box 1067, Brewster, MA 02631, the Board finds: 1. Applicant seeks a SPECIAL_ PERMIT under SECITON 139 -22H to add an Employer Dormitory in the administration building's second floor of its Major Commercial Develop tent located OFF NOBADEER FARM ROAD, Lot 3 on Land Court Plan #26984 -B and I_.ot 17 on Land Court Plan #26984 -H in the RESIDEN- TIAL- COMMERCIAL Zoning District. 2. Applicant has constructed the administration building as part of a MCD authorized by the Planning Board by Special Permit No. 2 -84 granted .July 23, 1984, puruant to Section 139 -9B(4) of the Zoning By -Law. Under Planning Board file No. 1 -85, that Special Permit has recently been amended. The second floor of the administration building now accovvn3lates a two - bedroom apartment of 840 SF constituting the principal dwelling unit on the property. The employer dormitory now sought by Applicant would be similarly located above administrative offices and serge a secondary pur- pose of added plant security. It would be limited to no more than 4 persons, each a valid employee of Nantucket Sun Nominee Trust (or a successor owner or tenant of the premises) and not more than 1000 SF floor space. 3. As we react the new first sentence of Section 139 -9B (4)(b), adopted at the ATM effective 4/1/851 the Planning Board is the sole special permit granting authority in MCD cases such as this. E?owever, Applicant asks relief here as well as from the Planning Board to avoid future un- certainty, and so we proceed on that basis. 4. Theemployer dormitory would be located remote from any off -site residential useicentrally within Applicant's property. No objection was heard and the Planning Board's recommendation was favorable. Accordinx;ly, (067 -85) we find that the proposed employ- U, r ^�Z tort/ ��.: e �.�'c�''l �� tie ? n ?-1,rmon- th the general purpose and intent r;f , I_ci ��� �:,+�;tf�ruF' iect to the following conditions: (a) Occupancy would not exceed pk2r.sons, each a valid employee as noted above; (b) Second - story administration huildi.ng floor space would be used not to exceed 1000 SF; (c) If used as such employer dormitory ceased, any further use would conform with the Zoning By -Law and, specifically any then - applicable provisions of the building cap Section 139.27; and (d) Applicant will also obtain from the Planning Board a Spe- cial Permit for such employer dormitory, or its adoption or confirmation of our grant of this Special Permit. 5. Accordingly, the Board, by UNANIMOUS vote, hereby GRANTS to Ap- plicant the requested SPECIAL PERMIT, subject to the foregoing conditions.
