At a Public Hearing of the BOARD OF APPEALS held on FRIDAY, AUGUST
2, 1985 at 1:30 p.m. in the Town and County (iuilding, Nantucket, in the
matter of the Application of BARBARA C. RICH for herself and ALMA C. COFFIN
(066 -85), address 2 Lily Street, Nantucket, MA 02554, the Board finds:
1. This is an Application for a SPECIAL PERMIT pursuant to SECTION
139 -33 and a VARIANCE under SECTION 139 -32 of the Zoning By -Law. The Appli-
cant seeks a Special Permit to change the use of an existing structure
from a non- conforming garage to a single- family residence. The existing
structure has non - conforming front and side yard setbacks. The Applicant
seeks a Variance to construct a second dwelling on the lot within twelve
(12) feet of the principal dwelling and therefore needs relief from SECTION
139 -7A (2)(b). The property is located at 41 PINE STREET, Sheet 55.4.1,
Parcel 116 and zoned RESIDENTIAL OLD HISTORIC.
2. Based upon a review of the Application, supporting documents,
plan:; and testimony, the Board finds that the proposed change of use of
the existing structure to a single - family dwelling is not substantially
more detrimental to the neighborhood than the existing use. The extended
rehabilitation of the structure will be an improvement to the neighborhood.
The proposed structure and use shall not extend beyond the footprint of
the existing structure. The roof line of the structure may be increased
from its current elevation of 15' and 17' to 17' and 19' respectively.
The proposed second dwelling cannot comply with the technical re-
quirements of Section 139 -7A (2)(b) of the Zoning By -Law due to unusual
size and shape of the existing structure and the shape of the lot and topo-
graphy. The second dwelling maV be Located on the lot not less than 10'
behind the rear. I:,uilding line of the existing, structure. For purposes of
this relief, Jefferson Lane is considered to define the front yard. The
proposed secondary dwelling shall. be otherwise sited and conform to the
ground cover requirements of the Zoning By -Law chapter.

On such condition, the Planning Board's recommendation is favorable.
3. The Board finds that the circumstances relating to the shape of
the lot and the siting of the buildings thereon do not generally affect
the ROH District in which the property is located and literal enforcement
of the By -Law would involve a substantial hardship to the Applicant. The
desired relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent or
purpose of the By -Law.
For the reasons and upon the conditions set forth herein concerning
footprint and roof height of the principal dwelling; siting, height and
screening of the secondary dwelling; and off - street parking spaces; the
Board, by UNANIMOUS vote, hereby GRANTS the Applicant the requested relief
for 41 Pine Street, Nantucket, MA.
