DECISION:
At a Public Hearing of the BOARD OF APPEALS held on FRIDAY, JULY 12,
1985 at 1:30 p.m. in the Town and County Building, Nantucket, in the matter
of the Application of WILLIAM C. CAMERON AND DANIEL P. SWEENEY, III.
(060 -85), address 112 Main Street, Nantucket, MA 02554, the Board finds:
1. Applicants seek a SPEICAL PERMIT under Zoning By -Law SECTION
139 -16C reducing the ten -foot easterly side lot setback distance to five
feet to the extent, and only to the extent, necessary to validate the exist-
ing siting of their recently constructed principa'_ dwelling. The premises
are located on WEST CHESTER STREET, LOT 4 of PLAN BOOK 22, PAGE 125,
2. At the July 12, 1985 hearing, Applicants' counsel corrected the
location of the premises marked on Assessor's Map accompanying the Appli-
cation form as Parcel No. 533. Actually, the premises resulted from a sub-
division of 1.3 A Parcel No. 343 and abut Parcel No. 354 to the east. The
difference may to some extent be material to objections of record, notably
those of the Sutphens of Parcel No. 362 next eastward.
3. Counsel for Applicants explained that the dwelling was sited out-
side the easterly side lot setback in accordance with the initial (but
erroneous) survey by John Shugrue, registered professional land surveyor.
In connection with a question of height compliance with the Certificate of
Appropriateness from the Historic District Commission, a second survey and
thega third were undertaken, these in agreement showing the northeast
foundation corner within the 10 -foot side lot setback. A sketch plan of May
28, 1985 received at the hearing shows the discrepancy. A plot plan of
April 30,1985 by another surveyor is marked to show a triangle of about
100 SF from Parcel No. 354 (Lot 1, Plan 17 -60) which Applicants might seek
to acquire to bring their dwellin.g into conformity without structural re-
location.

4. To the extent the reasons for opposition were clear, they appeared
addressed to the action of the HDC in permitting such a tall structure to
be sited at the top of the land rise. The lateral displacement of a few
feet in siting had no material impact on their visual and aesthetic concerns.
The immediate abuttors to the east made no objection. Water run off is
apparently not aggrevated. The Planning Board's recommendation was favorable.
5. No evidence was offered that improper siting was intentional or
to Applicants' advantage. (This is their Section 139 -27F dwelling.) To the
contrary, an unusual surveying effort proved necessary to confirm the origi-
nal error.
6. The only apparent criteria for our granting the requested Special
Permit is that the permitted reduction to a 5 -foot side lot setback be in
harmony with the general purposes and intent of the zoning chapter (Sections
139 -16C and 139 -30A). Hardship need not be shown. We find that harmony
present but, in light of the oppositionoimpose the following conditions
understood to be acceptable to Applicants:
a. The 10 -foot easterly side lot setback is reduced to the ex-
tent, and only to the extent, enabling the existing dwelling
to remain with its present siting. Such relief only applies
to the existing building, not to any subsequent additions.
b. Applicants shall provide effective landscaping across the
easterly elevation of their dwelling.
7. Accordingly, by UNANIMOUS vote, the Board hereby GRANTS to Appli-
cants the requested SPECIAL PERMIT under Section 139 -16C9 subject to the
above- stated conditions.
