(051 -85) Enclosed, please find notice of a decision of the BOARD OF APPEALS which has this day been filed with the Town Clerk. Any appeal from this action shall be made pursuant to Section 17 of Chapter 0A of the General Laws, and shall be filed within twenty (20) days after this date. William R. DECISION: The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, JUNE 7, 1985 at 1:30 p.m. in the Town and County Building, Nantucket, rendered the following decision in the Application of CHARLES SAYLES, JR. (051 -85) of 114 Washington Street Extension, Nantucket, MA 02554. 1.Applicants seek relief by SPECIAL PERMIT or VARIANCE from the provisions of Zoning By —Law SECTION 5.1 (codified as Section 139 -16A) con- cerning intensity regulations and specifically ground cover. If relief is granted, Applicants would be able to construct an 8' by 14' addition to their single- family residence by conversion of an existing scalloping shanty. The property is located at 114 WASHINGTON STREET EXTENSION, Lot 3A of Plan Book No. 16 at Page 95 and is in the RES IDENTIAL- COMMERCIAL Zoning District. 2. Based upon a site plan, it appears that a determination of ground cover favorable to Applicants is clouded by indication of an ease- ment. If reckoned at less that 5,000 SF, the property with proposed add- ition would be more non - conforming though evidently not to a significant extent. 3. No opposition was heard, the recommendation of the Planning Board being favorable. 4. In the mixed -use neighborhood of the premises, the proposed add- ition is found not to be substantially more detrimental to the neighbor- hood but in harmony with the general purposes and intent of the By -Law chapter. Hardship is further found with uniqueness as to the easement.. 5. Accordingly, by UNANIMOUS vote, this Board GRANTS to Applicants the relief requested. i.
