DECISION:
The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, JUNE 7,
1985 at 1:30 p.m. in the Town and County Building, Nantucket, rendered
the following decision in the Application of THE DOWNY FLAKE, INC. (050 -85)
c/o Karsten Reinemo, Sr. of Hooper Farm Road, Nantucket, MA 02554.
1. Applicant seeks a SPECIAL PERMIT under Zoning By -Law SECTION 71
(codified as Section 139 -33) for further extension of a pre- existing non-
conforming use beyond that allowed by Special Permit and Variance dated
August 31, 1984 (No. 060 -84). Applicant also asks for relief by SPECIAL
PERMIT from the added parking requirements of SECTION 6B, specifically
under 6B7 (codified as Section 139 -18G). The premises are located at 23
FEDERAL STREET, Lot 3, shown in Plan Book 21, Page 31 and in the RESIDEN-
TIAL-COMMERCIAL Zoning District.
2. Through counsel, Applicant limited the proposed extension of
use to the basement where allowed storage use would be replaced by a tra-
vel service use. As represented, the need for storage did not develop.
Applicant obtained a full lease for its off - premises Downy Flake restau-
rant operations, obviating any prospect for requiring the present premises
to carry on that business.
3. At present, Garrison's travel service is using the basement on
a leased basis with temporary Certificate of Occupancy with its continuance
dependent upon relief favorable to Applicant in this proceeding. Where
a storage use requires one off - street parking space (waived in our No. 060-
84) the services use would require 3 parking spaces, an increase of two
to be waived. Steve Butler, Assistant Building Inspector, noted the pre-
dominant foot traffic occa sioned by the travel service use, the first
floor retail art gallery similarly attracting relatively few auto - driving
customers.
4. No opposition was heard, the sole letter of record favoring the

A Public Hearing of the BOARD OF APPEALS will be held on
FRIDAY, JUNE 7, 1985 at 1:30 p.m in the TOWN AND COUNTY BUILDING,
FEDERAL AND BROAD STREETS, NANTUCKET, on the ,Application of DOWNY
FLAKE, INC. (03C1 -85) seeking a SPECIAL PERMIT under SECTION 7I
