DECISION:
The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, MAY 24, 1985
at 1 :30 p.m. in the Town and County Building, Nantucket, rendered the follow-
ing decision in the Application of STEPHEN SILVERIO AND KEITH HAGEDORN
(045 -85) of P.O. Box 2204, Nantucket, MA 02554 and 39th T.A.S., Pope
North Carolina, respectively.
1. Applicants seek a SPECIAL PERMIT under SECTION 7C.j (codified as
Section 139 -27J, Rate of Development or Building Cap) of the Zoning By -Law.
The property subject to the Section 139 -27F covenant is located at FARM ViFw
DRIVE, MIACOMET, Plan 28933 -K, Lot 60 in the RESIDENTIAL - COMMERCIAL -2
District.
2. The Application was heard at our Public Hearing meeting of May 24,
1985. Applicant Silverio presented a two -page statement of his hardship and
a letter of '-lay 10, 1985 from co- Applicant 11agedorn. The latter has peen
relocated to Pope Air Force Base in North Carolina on active duty and has no
continuirl� usage of the premises. A consequent heavier financial burden is
thrown on the Applicant remaining on Island. Construction of the house has
been more costly than projected and not completed.
3. the - emaining Applicant's on-- island business par_tr,ershi.p has been
dissolved with buy -out 'Durclens addink to his financial hardship, together
with loss of prospective income.
4. If relieved of the Covenant obligations by Special Permit, Appli-
cants are willing to limit any rentals, pending sale of the premises, to a
natural person domiciled n Nantucket, in furtherance of the housing objec-
tives of the "cap." The ri,2jht to sell would nc,rietheless he unrc.stricted.
5. No opposition was expressed from the Plannin Board or others.

1) Original intention was a year -round home for S. Silverio, second
home for K. Hagedorn, who was scheduled for duty at Westover Air
Force Base, Chicopee, Ma.
2) K.Hagedorn has unexpectey been reassigned to Fayetville, N.C.
this puts some added financial stress on S.Silverio because
he will pay a greater share share of mortage because K.Hagedorn
cannot use house as intended
